1. 2. 3. DEPARTMENT OF ENERGY DESIGNATION ORDER NO. 00-11.00B TO THE UNDER SECRETARY (OF ENERGY) DESIGNATION. Pursuant to the authority vested in me as Secretary of Energy by the Department of Energy (DOE) Organization Act (P.L. 95-91), as amended, I designate to the Under Secretary (of Energy} the authority to act as my designee, as the term is used in the Internal Revenue Manual, Part 11, Chapter 3, Section 29.6, acting separately to request tax delinquency account status and other tax related information from the Internal Revenue Service, pursuant to 26 U.S.C. 6103(1)(3), for applicants to the loan guarantee programs under Title XVII of the Energy Policy Act of 2005, as amended (42 U.S.C. 16511); Section 2602{c) of the Energy Policy Act of 1992, as amended (25 U.S.C. 3502{c)); and the loan program under Section 136 of the Energy Independence and Security Act of 2007 {P.L. 110-140}, as amended. RESCISSION. DOE Designation Order 00-11.00A is herepy rescinded. LIMITATION. 3.1 This designation covers all parts of the Department of Energy, except the Federal Energy Regulatory Commission. 3.2 Pursuant to this Designation Order, the Under Secretary (of Energy} shall be governed by the rules and regulations of DOE, and the policies and procedures prescribed by the Secretary of Energy, or.his delegates. 3.3 3.4 Nothing in this Designation Order shall preclude the Secretary of Energy from exercising any of his/her authority whenevedn his/her judgment the exercise of such authority is necessary. Nothing in this Designation Order shall be construed to supersede or otherwise interfere with the authorities provided to the Under Secretary (of Energy) by law or by delegation. 3.5 The Under Secretary (of Energy) will ensure that tax delinquent account and other tax related information obtained by the Department is properly safeguarded and secured, that only persons with a "need to know" such information will have access to it, that the information will be stored in an appropriate manner, and that the information will be properly disposed of when the need to maintain such records ceases. This Designation Order may be redesignated to the Executive Director of the Loan Programs Office (LPO); the Chief Op-erating Officer of LPO; the Director ofthe Loan Origination Division of LPO; and the Director of the Portfolio Management Division of LPO. DURATION AND EFFECTIVE DATE. 5.1 All actions pursuant to any authority provided prior to this Order or pursuant to any authority granted by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended, .or superseded. 5.2 A copy of this Designation Order shall be provided to DO E's Office of Management, which manages the Secretarial Delegations of Authority System. 5.3 This Designation Order is effective ____ _ Rick Perry Secretary of Energy Nov 24, 2019
