NATIONAL NUCLEAR SECURITY ADMINISTRATION DESIGNATION ORDER NO. 00-29.00A TO THEODORE A. WYKA 1. DESIGNATION. Pursuant to the authority vested in me under Sections 3212 and 3261 of the National Nuclear Security Administration (NNSA) Act (50 United States Code 2402, 2461 ), I designate Theodore A. Wyka, the Principal Deputy Associate Administrator for Safety, Infrastructure, and Operations, as the NNSA Cognizant Secretarial Officer (CSO) for safety-related matters. Although the term CSO is not consistently used in Department of Energy (DOE) directives, NNSA safety-related CSO functions and responsibilities are established in Departmental regulations and directives, and are described in NNSA Supplemental Directive (SD) 450.2A, Functions, Responsibilities, and Authorities (FRA) for Safety Management (or successor document). See the NNSA FRA and the attachment to this Order for the specific authorities conveyed. Included within the NNSA safety CSO designation are Startup and Restart Approval Authorities specified in DOE Order 425. lD, Verification of Readiness to Start Up or Restart Nuclear Facilities: a. Startup and Restart Authority for new Hazard Category 3 nuclear facilities, and restart authority for all NNSA nuclear facilities. These authorities may be delegated to the appropriate Field Office Manager. b. Startup Authority for new Hazard Category 2 nuclear facilities with a total project cost less than $200M. This authority may be delegated (not to be delegated or re-delegated lower) to the appropriate Field Office Manager if the following conditions are satisfied: • The processes employed in the new facility are not significantly different than those in other facilities at the site that are currently authorized to operate. • The hazards posed by activities in the new facility are not significantly different than the hazards posed by activities in other facilities at the site that are currently authorized to operate. • The safety systems and controls, including administrative controls, cited in the Documented Safety Analysis for the new facility are not significantly different from the safety systems and controls cited in the Safety Basis for other facilities at the site : that are currently authorized to operate. 2. RESCISSION. The previous Designation Order 00-29.00 is hereby rescinded. Current delegations made by previous NNSA CSOs remain in effect. 3. LIMITATION. Although delegations of nuclear safety authorities from the previous CSO to Field Office Managers remain in effect, for safety basis approval authorities, the CSO retains approval authority for accident scenarios having calculated mitigated consequences exceeding the Evaluation Guideline of 25 rem. 4. AUTHORITY TO DELEGATE. The NNSA safety CSO may delegate specific safety authorities to individuals, subject to requirements for delegation and re-delegation in DOE and NNSA regulations, directives, and limitations expressed herein. 10 Code of Federal Regulations (CFR) 820 prohibits delegation of the CSO responsibilities for approval of exemptions to 10 CFR 830. Authorities delegated by the CSO are delegated to individuals, not positions. Re-delegation (where permitted by regulation and directives) must be approved by the CSO for safety-related matters. 5. DURATION AND EFFECTIVE DATE. 5.1 All actions pursuant to any authority designated prior to this Order or any authority delegated pursuant to previous designations, taken prior to and in effect on the date of this Order, are ratified and remain in force as if taken under this Order, unless or until rescinded, amended or superseded.

5.2 A copy of this Order shall be provided to NNSA's Management and Budget, Business Services, Policy Division. 5.3 This Order is effective July 22, 2018.
