DESIGNATION ORDER NO. 00-12.00
TO THE EXECUTIVE DIRECTOR OF LOAN PROGRAMS AND
DIRECTOR OF THE ADVANCED TECHNOLOGY VEHICLES MANUFACTURING
INCENTIVE PROGRAM
1. DESIGNATION. Pursuant to the authority vested in me as Secretary of Energy by the
Department of Energy (DOE) Organization Act (P.L. 95-91), as amended, I hereby
designate each of the Executive Director of Loan Programs and the Director of the
Advanced Technology Vehicles Manufacturing Incentive Program, as my designee, as
the term is used in the Internal Revenue Manual, Part 11, Chapter 3, Section 29.6, acting
separately to request tax delinquency account status and other tax related information
from the Internal Revenue Service, pursuant to 26 U .S.C. 6103(1)(3), for applicants to the
Department's Advanced Technology Vehicles Manufacturing Incentive Program under
Section 136 of the Energy Independence and Security Act of2007 (P. L. 110-140), as
amended.
2. RESCISSION. None.
3. LIMITATION.
a. Pursuant to this Designation, each of the Executive Director of Loan Programs and
the Director of the Advanced Technology Vehicles Manufacturing Incentive Program
shall be governed by the rules and regulations of DOE, and the policies and procedures
prescribed by the Secretary of Energy, or his delegates.
b. Nothing in this Designation shall preclude the Secretary of Energy from exercising
any of his authority whenever in his judgment his exercise of such authority is necessary
to administer the functions vested in him.
c. Each of the Executive Director of Loan Programs and the Director of the Advanced
Technology Vehicles Manufacturing Incentive Program will ensure that tax delinquent
account and other tax related information obtained by the Department is properly
safeguarded and secured, that only persons with a "need to know" such information will
have access to it, that the information will be stored in an appropriate manner, and that
the information will be properly disposed of when the need to maintain such records
ceases.
4. AUTHORITY TO REDESIGNATE. Neither the Executive Director of Loan Programs
nor the Director of the Advanced Technology Vehicles Manufacturing Incentive Program
may redesignate this authority further.
5. DURATION AND EFFECTIVE DATE.
a. This Designation shall remain in full force and effect unless or until rescinded,
amended, or superseded by order of the Secretary of Energy.
b. This Designation is effective upon its execution.
