[RESCINDED][RESCINDED] DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-88 TO THE DEPUTY SECRETARY Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) and by Section 305 of the Defense Production Act of 1950, as amended (50 U.S.C. App. 2095), Executive Order 12242, (September 30, 1980) and Section 642 of the Department of Energy Organization Act (Pub. L. 95- 91), there is hereby delegated to the Deputy Secretary, on a nonexclusive basis: 1. the authorities enumerated in subsections 305[b][i][A][i] and (ii), [c][1][B], [c][3], [d][2], [d][3], [d][5], [d][6], [e] and [g][2][C] of the Defense Production Act of 1950, as amended; 2. the authority, in connection with the exercise of the authorities delegated in paragraph 1, to make any related determinations required by sections 301 and 305 of the Defense Production Act, as amended. The authorities delegated in this Delegation Order may be exercised only in furtherance of Department of Energy Solicitation Announcement No. DE-PS60-81RA50481. The authority delegated to the Deputy Secretary by this Order may be redelegated, in whole or part, as may be appropriate. In exercising the authority delegated by this Order or as redelegated pursuant thereto, the delegate(s) shall be governed by rules and regulations of DOE and the policies and procedures prescribed by the Secretary or his delegate(s). All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded. Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his judgment his exercise of such authority is necessary or appropriate to administer the functions vested in him.
