[RESCINDED][RESCINDED] DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-79 TO THE UNDER SECRETARY Pursuant to the authorities vested in me as Secretary of Energy (“Secretary”) and by Section 642 of the Department of Energy Organization Act (Pub. L. 95-91), Section 305 of the Defense Production Act of 1950, as amended (50 U.S.C. App. 2095), and by Executive Order 12242 dated September 30, 1980 pertaining to synthetic fuels, I delegate to the Under Secretary the authorities contained in Section 305 (d)(2) of the Defense Production Act to make determinations pertaining to the acceptability of bids and to authorize negotiation of contracts for purchase and commitments to purchase as may be necessary. This delegation is effective only with respect to the Program Solicitation for Proposals for Financial Assistance under Title I, Part A of the Energy Security Act (Pub. L. 96-294) for the Development of Synthetic Fuels Under the Defense Production Act, issued October 15, 1980 (Solicitation Announcement No. DE-PS60-81RA50481). This authority delegated to the Under Secretary by this Order shall not be delegated further in whole or in part. In exercising the authority delegated by this Order the delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded.
