0204-101, Delegation Order No. 0204-101 to the Assistant Secretary for Defense Programs

[RESCINDED][RESCINDED] DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-101 TO THE ASSISTANT SECRETARY FOR DEFENSE PROGRAMS Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) and by Executive Order 12356, entitled “National Security Information,” (“Executive Order”) and by Section 642 of the Department of Energy Organization Act (Pub. L. 95-91), there is hereby delegated to the Assistant Secretary of Defense Programs the authority to: 1. Act as the Senior Agency Official responsible for the direction and administration of the DOE information security program. (Executive Order Section 5.3(a)). 2. Originally classify information as Top Secret, Secret, and Confidential. (Executive Order Section 1.2(d)(2)). 3. Exercise all other authorities vested in the Secretary under the Executive Order and in any implementing directives issued pursuant to Section 5.2(b)(1) of the Executive Order, except the authority to request of the Attorney General an interpretation of the Executive Order with respect to any question arising in the course of its administration. (Executive Order Section 6.2(b)). The authority delegated to the Assistant Secretary for Defense Programs may be further delegated, consistent with the terms of the Executive Order, in whole or in part, to any other official of the Department. In exercising the authorities delegated by this Order or as redelegated pursuant thereto, the delegate(s) shall be governed by the rules and regulations of the DOE and the policies and procedures prescribed by the Secretary or his delegate(s). All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended, or superseded. Nothing in this Order shall preclude the Secretary from exercising any of the authorities so delegated whenever in his judgment his exercise of such authority is necessary or appropriate to administer the functions vested in him.
