DEPARTMENT OF ENERGY REDELEGATION ORDER NO. 00-008.09 TO THE MANAGER OF THE CHICAGO OPERATIONS OFFICE 1. DELEGATION. Pursuant to Secretary of Energy Delegation provided to me under Delegation Order 00-008, I delegate to the Manager of the Chicago Operations Office authority to take the following actions: 1.1 Take all necessary actions to acquire, by purchase, lease, or otherwise, real property interests; take necessary additional action following the initiation of condemnation proceedings and the execution of declarations of taking; and exercise all authority of the Secretary regarding the management and disposal of Departmental real property, excluding the acceptance by donation of real property. This authority does not extend to initiation of condemnation proceedings or execution of declarations of taking. All real estate actions shall be subject to approval by a Department of Energy certified reality specialist. In addition, the Office of Management, Budget and Evaluation, the Office of General Counsel, and the Director of the Office of Science shall be formally notified 90 days in advance of the final disposal, by sale or lease, of any Departmental real property under DOE property disposal authorities. This notification requirement does not include the demolition of buildings by DOE or its contractors. 1.2 Approve personnel actions involving positions at the GS-15 level and below or equivalent in the competitive and excepted service. 1.3 Approve personnel actions involving positions above the GS-15 or equivalent level not requiring Executive Resources Board approval. 1.4 Approve personnel actions relating to the appointment of experts and consultants pursuant to section 3109 of title 5 of the United States Code (Schedule A Authority). 1.5 Approve developmental or training assignments external to the Department of Energy (DOE or Department) of one year or less. 1.6 Under 5 U.S.C. 2903, administer the oath of office and execute appointment affidavits for all appointments for the DOE. 2. LIMITATION. 2.1 In exercising the authority delegated in this Order, a delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary or delegate(s). (Rescinded by 00-008.01-02) 2 2.2 Nothing in this Order precludes the Secretary from exercising any of the authority delegated by this Order. 2.3 Nothing in this Order shall be construed to supersede or otherwise interfere with the authorities provided to the Administrator for Nuclear Security by law or by delegation. Furthermore, nothing herein constitutes authority to exercise authority, direction, or control of an employee of the National Nuclear Security Administration or its contractors. 2.4 Any amendments to this Order shall be in consultation with the Department of Energy General Counsel. 3. AUTHORITY TO REDELEGATE. 3.1 Except as expressly prohibited by law, regulation, or this Order, the Manager of the Chicago Operations Office may delegate this authority further, in whole or in part. 3.2 Copies of redelegations and any subsequent redelegations shall be provided to the Office of Management and Operations Support, which manages the Secretarial Delegations of Authority system. 4. DURATION AND EFFECTIVE DATE. 4.1 All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended or superseded. 4.2 This Order is effective December 11, 2001.
