Certain Excepted Service Position

A position that is not covered under 5 C.F.R. 731.101, Purpose. This includes positions in the excepted service that are not eligible for non‑competitive conversion to the competitive service (e.g., EJ, EN and EK, attorney). These positions require a fitness determination in lieu of a suitability determination (see paragraph 7.i). DOE uses equivalent factors applied in a suitability adjudication when making fitness determinations.
