FROM: SUBJECT: Department of Energy Office of Science Washington, DC 20585 March 21, 2011 SH FOR FIELQ OPERATIONS Delegations of Authority for Office of Science Operations and Safety, and Property Management Designated authorities assigned through the responsibilities listed in Department of Energy (DOE) Directives and Rules or otherwise delegated to me through DOE Delegation Orders are established to ensure objective and consistent decision making by appropriate levels of line management. This memorandum delegates to you the Office of Science (SC) specific authorities listed in Attachment 1. Unless otherwise specified, these may not be re-delegated. The authorities listed in the attachment will continue until rescinded, amended or superseded in writing. Radiation Protection functions (10 CFR 835 Subpart B 835.101 (a) and (b)): Review and approve contractor Radiation Protection Program (RPP). 2. Quality Assurance functions (10 CFR 830 Subpart A 830.121 (b).(1), (2), and (3); and DOE O 414.1C, 5.b.(5)): Review and approve contractor Quality Assurance Program (QAP). 3. ES&H Reporting functions (DOE O 231.1A, 5.c.(3).(a). and M 231.1-2, 4.2.a): Designation as Occurrence Reporting Program Manager. Authority for approval of Operational Emergency and Significance Category 1 Final Occurrence Reports may not be re-delegated. Authority for approval of Significance Category R and 2 Final Occurrence Reports may be assigned to a qualified Facility Representative consistent with requirements under DOE M 231.1-2, 5.6.c. (the term Facility Representative as used in M 231.1-2 includes selected line management staff if a Facility Representative is not assigned). 4. Conduct of Operations functions (DOE O 422.1, 5.a.(1)): Determine applicability of Conduct of Operations Order to nuclear and non-nuclear facilities. Property Management 1. Real Property functions (DOE O 430.1B, 4.b.(1). and 5.e.(1).): Take all necessary action to acquire, by purchase, lease, or otherwise, real property interests; take necessary additional action following the initiation of condemnation proceedings and the execution of declarations of taking; and exercise all authority of the Secretary regarding the management and disposal of Departmental real property, excluding the acceptance by donation of real property. This authority does not extend to initiation of condemnation proceedings, executions of declarations of taking, or approval of indemnification provisions or clauses in contracts, subcontracts, leases, or other real property documents. In exercising this authority, all real property actions must be reviewed and approved by a DOE Certified Realty Specialist (CRS) prior to execution in accordance with requirements in DOE O 430.1B, Real Property Asset Management. Attachment 1 This authority includes signature approval on real property documents for direct DOE transactions not involving DOE contractor or subcontractor execution. In the case of indirect transactions, certain real property transactions by DOE contractors must be conducted in accordance with the requirements ofDEAR 917.74, Acquisition, Use and Disposal ofReal Estate, and DEAR 952.217-70, Acquisition ofReal Property; and property actions by recipients under DOE financial assistance agreements must satisfy the requirements of 10 CFR 600.132, Real Property, 600.231, Real Property, and 600.321, Real Property and Equipment.
