The Under Secretary of Energy Washington, DC 20585 July 14.2010 MEMORANDUM FOR WARREN F. MILLER JR. FROM: SUBJECT: ASSISTANT SECRETARY FOR NUCLEAR ENERGY KRISTINA M. JOHNSON f) Delegation of Approval Authority The Department is in the process of reviewing and revising its safety and security policies to ensure they are efficient and effective while providing the assurances needed to protect our mission goals and assets. This includes placing decision­ making authorities at the lowest appropriate level of contractor and Federal management (reference the Deputy Secretary's March 16, 2010, memorandum, Department of Energy 2010 Safety and Security Reform Plan). Department of Energy (DOE) Order 470.3B, GRADED SECURITY PROTECTION POLICY, requires the development, and submission to Headquarters, of implementation plans for the Order, to include analyses and recommended actions responsive to the defined protection levels. The plans will include those actions necessary to carry a site forward from the 2003 Design Basis Threat, or a site's implemented threat level. The implementation plans are to be approved by the Deputy Secretary. Consistent with the Department's security reform initiatives, the Deputy Secretary has delegated to me approval authority for Graded Security Protection (GSP} policy implementation plans. I am further delegating to the Assistant Secretary for Nuclear Energy, the authority to approve GSP policy implementation plans for those sites and facilities in which the Office of Nuclear Energy is the Program Secretarial Officer. The Office of Health, Safety and Security (HSS) shall be consulted in these approvals. If HSS disagrees with an approval of an implementation plan (IP), I shall be notified and the IP shall not be approved until the reason(s) for the disagreement is (are) resolved, or acted upon by my Office. This approval authority may be further delegated to Federal Mangers as determined to be consistent with DOE policy and mission objectives. cc: G. Podonsky, HS-1
