Approved: 12-21-2017 SUBJECT: NATIONAL ENVIRONMENTAL POLICY ACT COMPLIANCE PROGRAM 1. PURPOSE. This Policy establishes DOE’s expectations for implementing the National Environmental Policy Act of 1969 (NEPA); the Council on Environmental Quality (CEQ) Regulations for Implementing the Procedural Provisions of NEPA (40 CFR Parts 1500-1508); and the DOE NEPA Implementing Procedures (10 CFR Part 1021). 2. CANCELLATION. DOE O 451.1B Chg 3 (AdminChg), National Environmental Policy Act Compliance Program, dated 10-26-2000. Cancellation of a directive does not, by itself, modify or otherwise affect any contractual or regulatory obligation to comply with the directive. 3. POLICY. DOE prioritizes NEPA compliance and delegates authority to the Heads of Departmental Elements to ensure an efficient and effective risk-based approach to the implementation of DOE's NEPA compliance program. All participants are responsible for controlling costs and time while maintaining quality of the process, activities and results. a. The Secretary will ensure compliance with 40 CFR Parts 1500-1508 and 10 CFR Part 1021. b. Heads of Departmental Elements will, for matters under their office's purview: (1) Maintain and delegate responsibility for NEPA compliance at their discretion, including to Heads of Field Elements. (2) Maintain at least one DOE NEPA Compliance Officer with the requisite knowledge and experience to provide leadership, guidance and advice. (3) Designate a DOE NEPA Document Manager with the requisite knowledge and experience for each Environmental Impact Statement (EIS), Environmental Assessment (EA), and Supplement Analysis (SA). (4) Ensure access to information, coordination and collaboration, as needed. (5) Develop and maintain updated Departmental Element specific resources, as needed. 4. CONTACT.
