To establish Department of Energy (DOE) policy, procedures,P U R P O S E . — authorities, and requirements for the establishment of a Federal Radiological Monitoring and Assessment Center (FRMAC), as set forth in the Federal Radiological Emergency Response Plan (FRERP) (50 FR46542). 2. SCOPE. The provisions of this Order apply to all Departmental and contractors as provided for by law and/or contract and as by the appropriate Contracting Officer. Elements implemented 3. APPLICATION TO CONTRACTS. The provisions of this Order are to be applied to covered contractors, and the provisions will apply to the extent implemented under a contract or other agreement. A covered contractor is a seller of supplies or services involving radiological emergency response awarded to a Management and Operating contract. 4. POLICY. It is the policy of the Department to: a. Establish and maintain plans and procedures for providing DOE resources and support in response to requests for radiological emergency assistance from Federal, State, local, and tribal governments, in accordance with provisions set forth in FRERP. b. Establish and maintain a capability for coordinating the radiological monitoring and assessment activities of other Federal agencies when providing radiological assistance under FRERP. c. Assist State, local, and tribal jurisdictions in preparing for and responding to radiological emergencies. 5. REFERENCE. a. DOE 5000.3A, OCCURRENCE REPORTING AND PROCESSING OF OPERATIONS INFORMATION, of 5-30-90, which establishes a broad spectrum of information reporting from normal operations to emergency conditions. b. DOE 5400.1, GENERAL ENVIRONMENTAL PROTECTION PROGRAM, of 11-9-88, which establishes environmental protection program requirements, authorities, and responsibilities for DOE operations. The Federal Radiological Emergency Response Plan (50 FR 46542), of 11-8-85, which outlines Federal agency roles in responding to peacetime radiological incidents and contains the Federal Radiological Monitoring Assessment Plan. Title 40 Code of Federal Regulation (CFR) 300$ National Oil and Hazardous Substance Pollution Contingency Plan, which implements the response powers and responsibilities created by the Comprehensive Environmental Response, Compensation , and Liability Act of 1980 and the authorities created by the Clean Water Act, as amended to minimize damage from oil and hazardous substances discharges, including containment, disposal, and removal, and to protect the environment from the damaging effects of pollution discharges. Title 44 CFR 350, Review and Approval of State and Local Radiological Emergency Plans and Preparedness, which establishes policy and procedures for review and approval of State and local emergency plans and preparedness for coping with the offsite effects of radiological emergencies that may occur at commercial nuclear power facilities. Public Law 83-703, Atomic Energy Act of 1954, as amended, which gives DOE the authority to protect the health and safety of the public in the national interest where the use of nuclear materials is involved. Deputy Assistant Secretary for Military Application (DP-20) Operational Emergency Management Plan. 6. DEFINITIONS . See DOE 5500.1B, Attachment 2. 7. CONCEPT OF OPERATIONS. a. FRMAC will coordinate and provide Federal assistance in response to major radiological incidents. The response includes offsite assistance, as appropriate, when requested by Federal, State, local, and tribal authorities in dealing with the impacts of radiological incidents. 3 q. r. 4 DOE 5530.5 7-10-92 b. A FRMAC will be established when a major radiological emergency has been declared. Any declaration of a major radiological emergency will be made by the DOE Headquarters (HQ) Operational Emergency Management Team (OEMT) in consultation with DOE Nevada Field Office (NV). A major radiological emergency exists if a request for DOE assistance has been received from a DOE-owned facility or any State, local, tribal, or other Federal agency which requires capabilities exceeding those provided by the DOE RAP. c. In the event of a major radiological emergency, DOE will establish and manage a FRMAC. The FRMAC Director assigned by NV in coordination with the Program Secretarial Officer, will manage and coordinate the offsite monitoring and assessment activities of all Federal agencies in support of the State, local, or tribal government, and the Lead Federal Agency (LFA).

d. Initial requests for assistance to a radiological incident from outside the DOE complex could be directed to any of the Department’s sites, or directly to the HQ Emergency Operations Center (EOC). If the EOC is notified directly, immediate action will be taken to notify the Program Office (DP-20), who will evaluate the incident and implement an appropriate response. Requests transmitted to sites other than the HQ EOC will be evaluated by the DOE field activities and either forwarded to the HQ EOC, or if it is apparent that the incident does not constitute a major radiological incident, a RAP team will initially be deployed to the incident site. If, upon arrival, a determination is made that the incident exceeds the capabilities of the RAP team, the HQ EOC will be notified and the full notification process will be implemented. This may include DP-20 directing the activation of the OEMT and dependent on the severity of the incident, deployment of an advanced FRMAC, under the operational control of NV. This action might be followed with the deployment of the full FRMAC under the operational control of NV and direction of the OEMT. e. For an incident occurring at a DOE facility, the Department will be the Lead Federal Agency (LFA) and appoint the Lead Federal Agency Official (LFAO). FRMAC will be under the direct control of, and report to, the LFAO. DOE will also serve as LFA for incidents involving DOE materials in transit or for materials in DOE custody that are staged or stored at non-DOE facilities. The DOE response to non-DOE-sponsored transportation accidents will be in accordance with paragraph 7d above. DOE 5530.5 7-10-92 f. In a major emergency, with DOE HQ approval (DP-20), NV shall establish a FRMAC to be used as a coordination center and base of operation for the offsite Federal radiological monitoring and assessment efforts, as well as a location for integrating these efforts with those of the State, local, and tribal authorities. The DOE resources at the facility will be supplemented by personnel and equipment from other Federal agencies such as the Environmental Protection Agency (EPA), Nuclear Regulatory Commission, Federal Emergency Management Agency, and the Departments. of Agriculture, Commerce, Health and Human Services, Interior, Transportation, and Defense (DOD). After the emergency phase of the incident and at the earliest mutually-agreeable time, EPA will assume the long-term coordination of any additional Federal monitoring and assessment assistance in accordance with FRERP. The DOE radiological assistance will continue after this transfer of responsibility. 8. RESPONSIBILITIES AND AUTHORITIES. a. The Secretary. Many provisions in this Order permit and/or necessitate the exercise of discretion and/or judgment in carrying out the requirements. In those instances, the determination of whether, in the exercise of such discretion and/or judgment, the requirements of this Order were complied with, rests initially with the relevant Department authority and ultimately, with the Secretary. The Secretary retains the sole and final authority to determine what acts are necessary to comply with this Order. Further, the Secretary retains the authority to suspend any and all requirements under this Order whenever the Secretary deems necessary. This authority may be redelegate by the Secretary as appropriate. b. Assistant Secretary for Defense Programs (DP-1) shall: (1) Develop and promulgate policy on the Department’s role in the management and operation of FRMAC.

(2) Ensure the development and maintenance of plans and procedures for implementing FRMAC requirements incumbent on the Department, as set forth in FRERP. (3) Ensure appropriate resources are available to the HQ Program Office and Program Manager for establishing and maintaining an effective FRMAC capability in accordance with Departmental policy. 5 6 DOE 5530.5 7-10-92 (4) In coordination with the Director, OEMT declare that a major emergency exists and approve the establishment of a FRMAC. (5) Ensure liaison with appropriate Federal agencies to coordinate, plan, develop, negotiate, and maintain necessary interagency agreements. c. Deputy Assistant Secretary for Military Application (DP-20) shall: (1) (2) (3) (4) (5) (6) (7) (8) Develop, issue, and maintain the monitoring and assessment section of the FRERP. Provide programmatic guidance for implementation of DOE management and support of FRMAC. Budget and provide funding and other support required to establish and maintain a responsive FRMAC capability. Maintain liaison with HQ Elements of appropriate Federal agencies and assure that DOE fully participates in the planning, development, coordination, and execution of any related interagency agreements. Conduct drills and exercises to evaluate plans, procedures, and training of DOE organizations that are responsible for supporting a FRMAC. Manage and coordinate HQ support for response to requests for radiological assistance, which would require establishing a FRMAC. Activate the DP-20 OEMT upon notification of a major radiological incident, which would require establishing a FRMAC. Provide DOE membership on the Subcommittees of the Federal Radiological Preparedness Coordinating Committee (FRPCC) and on any HQ-level interagency planning committees required by the implementation of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980. DOE 5530.5 7-10-92 7 (9) Forward, through the Director of Emergency Operations, names of designated Energy Senior Officials (ESO) and FRMAC Directors to the National Response Center. (10) Ensure that necessary classification and UCNI guidance is prepared in accordance with DOE 5635.4 and DOE 5650.26. (11) Establish plans and procedures for compliance of criteria and standards of DOE 5500 series Orders. (12) Review and concur on FRMAC procedures. (13) Designate a DP-20 staff member to serve on the Emergency Management Advisory Committee (EMAC). d. Assistant Secretary for Environment, Safety, and Health (EH-1 ), shall conduct oversight as required to ensure those aspects of environmental protection, radiation safety, worker safety, and those aspects of public health and safety that deal with epidemiology and exposure to hazardous materials are properly addressed. e. Director of Emergency Operations (OE-1O), shall: (1) [n conjunction with DP-20, ensure that exercises of the FRMAC capabilities are coordinated within the overall DOE operational emergency exercise program. (2) Serve as the DOE point of contact, in coordination with DP-20, for membership on subcommittees of the FRPCC, and on any HQ-level interagency planning committees required by 50 FR 46542. f. Manager, DOE Nevada Field Office, shall: (1) (2) (3) Develop and maintain plans and resources for establishing and operating FRMAC and for coordinating the FRMAC resources in a major radiological incident. Identify and train personnel to manage response resources and coordinate FRMAC operations.

Prepare and submit to DP-20 a 5-year operations plan with supporting budget data and documentation for maintaining and operating FRMAC activities. DOE 5530.5 7-10-92 g. h. i. j. (4) (5) (6) (7) (8) (9) (10) Coordinate with DP-20 the appointment of the FRMAC Director. Coordinate with HQ (DP-20), regarding any recommendation for deployment of emergency response assets to establish a FRMAC in support of the FRERP. Develop and submit all FRMAC plans and procedures to DP-20 for concurrence or approval. Ensure that necessary classification and UCNI guidance is prepared in accordance with DOE 5635.4 and DOE 5650.2B. Provide immediate notification to DP-20 regarding any request to deploy FRMAC, followed by daily written status reports, and a final report within 10 working days after the FRMAC is terminated. Develop, support, and maintain the Department’s Aerial Measuring System (AMS) (Reference DOE 5530.4) and Nuclear Emergency Search Team (NEST) (Reference DOE 5530.2) capabilities for assistance to FRMAC. Through the cognizant contracting officer, require covered contractors to comply with the provisions of paragraphs 9, 10, and 11, as applicable. Manager, DOE Oak Ridge Field Office, shall also develop, maintain, and support the Radiation Emergency Assistance Center/Training Site (REAC/TS) to provide medical assistance to FRMAC when deployed. Manager, DOE Albuquerque Field Office shall develop, maintain, and support the Accident Response Group (ARG) to provide specialized, technical assistance in incidents involving nuclear weapons to FRMAC. Manager. San Francisco Field Office shall develop, maintain, and support the Department’s Atmosphere; Release Advisory Capability (ARAC) for assistance to FRMAC. Managers, DOE Albuquerque, Chicago, Idaho, Nevada. Oak Ridge, Richland, San Francisco. and Savannah River Field Offices and the DOE Brookhaven Area Office, shall maintain and support the Regional Coordinating Offices of the RAP as identified in DOE 5530.3. 8 DOE 5530.5 7-10-92 9 k. Heads of Departmental Elements shall include in each procurement request package, for each procurement requiring the application of this Order, the following: (1) identification of the Order; (2) identification of the specific requirements with which a contractor or ether awardee is to comply, or, if this is not practicable, identification of the specific paragraphs or other portions of this Order with which a contractor or other awardee is to comply; and (3) requirements for the flowdown of provisions of this Order to any subcontract or subaward. 9. ADMINISTRATIVE GUIDELINES. During the establishment and operation of a FRMAC, DOE will provide advice and radiological assistance upon request from other Federal agencies, State, local, and tribal agencies, private organizations, or private persons in accordance with the FRERP. a. Role of Radiological Assistance. The DOE radiological assistance in support of FRMAC will support State, local, or tribal authorities. Response personnel will cooperate with Federal, State, local, tribal, Government authorities, or private officials having jurisdiction over the activities at the scene. b. Location of Assistance. (1) Off site. The DOE assistance in support of FRMAC will, in most cases, be directed towards helping operations the State. local, or tribal authorities deal with the offsite impacts of a radiological incident. Offsite is the area where the general public normally has access (outside identified “onsite” boundaries).

(2) Onsite. The DOE assistance in support of FRMAC operations may be provided at a fixed facility within the area to which access is controlled by the facility or within an exclusion area, such as that established by the State in a transportation incident or by DOE/DOD in a weapons accident. In these cases, the request for assistance will normally come from the State, tribal, or Federal agency operating or regulating the facility responsible for the material involved in the accident. c. Notification of Headquarters. Request for radiological support which may entail the establishment of a FRMAC, including deployment of DOE emergency response assets will be directed through the HQ EOC. 10 DOE 5530.5 7-10-92 d. e. f. Public Information. Public information involving DOE assistance in support of FRMAC will be conducted in accordance with DOE 5500.4, FRERP, existing interagency agreements, and in coordination with State, local, and tribal officials. Security. In accordance with DOE 5635.4 and DOE 5650.26, DOE response teams shall protect classified information from unauthorized disclosure and take any necessary steps to secure classified materials until the authorized personnel arrive to take custody of the material. Limitations for Assistance. The DOE assistance in support of FRMAC shall not normally be provided: (1) When it is more appropriate for the organization or individual requesting assistance to obtain State, local, tribal, or commercial assistance; (2) When the State, local, and tribal resources are adequate for the situation; (3) When the requested DOE resources are being used in responses to existing emergencies involving other DOE facilities or activities; (4) In an off site response (except in cases of immediate threat to life and health) without LFA, State or local Government request for assistance; or (5) For nonradiological emergencies. 10. RADIOLOLGICAL ASSISTANCE PLANNING AND READINESS. a. FRMAC Operations. (1) FRMAC shall assure the technical integrity of the environmental data and maintain an accountable database of all offsite environmental data, provide exposure rate, isotope concentrations, and projected dose contours for the affected areas, and any other assessments requested by the States, tribes, or the LFA. DOE 5530.5 7-10-92 11 (2) In accordance with the FRERP, FRMAC may assist LFA in formulating recommendations for civil authorities. (3) The DOE FRMAC Director is responsible for the operation and management of FRMAC and for ensuring that DOE’s responsibilities for coordinating Federal radiological assistance under the FRERP are met, (4) The FRMAC location shall be selected after conferring with the affected State(s) and tribe(s); in some cases, potential FRMAC locations already may have been identified. Some States and/or tribes may choose to relocate their radiological monitoring operations to FRMAC; others may work through liaisons to coordinate the Federal, State, and tribal efforts. (5) The FRMAC support shall come from all Federal agencies and shall include appropriate specialized support capabilities (e.g., communications, logistics, photographic, video, administrative, Security, access control, security classification, mechanical support, radiation monitoring and assessment, radiation protection, public affairs support, medical support, etc.), and arrange for the necessary support. The FRMAC Director is responsible for identifying support requirements and acquiring these resources through the HQ OEMT. The FRMAC Director or ESO will be responsible for resolving any conflicts involving Federal resources offsite.

b. FRMAC Personnel. (1) The FRMAC staff will come from DOE, its contractors, and employees or contractor employees of other Federal agencies participating in FRMAC. (2) DOE shall provide the FRMAC Director at all times that DOE has responsibility for managing FRMAC. (3) As part of’ the FRMAC planning, NV shall identify and train candidates for FRMAC Director and the other principal FRMAC management positions. 12 DOE 5530.5 7-10-92 (4) The DOE staffing for FRMAC shall include trained and qualified personnel from appropriate Departmental HQ and Field elements, with primary DOE support coming from the personnel and equipment that comprise its emergency response assets/capabilities to include: ARG, ARAC, AMS, NEST, RAP, and REAC/TS. 11. REPORTING REQUIREMENTS. a. b. BY ORDER Initial notification of any request for deployment of DOE assets in support of a FRMAC shall be immediately reported through the Department’s EOC to DP-20. NV shall prepare and provide a daily status report to DP-20 and will maintain a copy of all reports for a final after action report, which will be submitted within 10 working days after the termination of any FRMAC activation. The FRMAC reporting requirements set forth in this Order are above and beyond requirements of DOE 5000.3A, “Occurrence Reporting and Processing of Operations Information,” which relate to occurrences at DOE facilities and the reporting requirements for which are the responsibility of the DOE Facility Manager. Response personnel will cooperate with Federal, State, local, tribal, Government authorities, or private officials having jurisdiction over the activities at the scene. b. Location of Assistance. (1) Off site. The DOE assistance in support of FRMAC operations will, in most cases, be directed towards helping the State, local, or tribal authorities deal with the offsite impacts of a radiological incident. Offsite is the area where the general public normally has access (outside identified “onsite” boundaries). (2) Onsite. The DOE assistance in support of FRMAC operations may be provided at a fixed facility within the area to which access is controlled by the facility or within an exclusion area, such as that established by the State in a transportation incident or by DOE/DOD in a weapons accident. In these cases, the request for assistance will normally come from the State, tribal, or Federal agency operating or regulating the facility responsible for the material involved in the accident. c. Notification of Headquarters. Request for radiological support which may entail the establishment of a FRMAC, including deployment of DOE emergency response assets will be directed through the HQ EOC. 10 DOE 5530.5 7-10-92 d. e. f. Public Information. Public information involving DOE assistance in support of FRMAC will be conducted in accordance with DOE 5500.4, FRERP, existing interagency agreements, and in coordination with State, local, and tribal officials. Security. In accordance with DOE 5635.4 and DOE 5650.2B, DOE response teams shall protect classified information from unauthorized disclosure and take any necessary steps to secure classified materials until the authorized personnel arrive to take custody of the material. Limitations for Assistance. The DOE assistance in support of FRMAC shall not normally be provided: (1) When it is more appropriate for the organization or individual requesting assistance to obtain State, local, tribal, or commercial assistance; (2) When the State, local, and tribal resources are adequate for the situation; (3) When the requested DOE resources are being used in responses to existing emergencies involving other DOE facilities or activities; (4) In an off site response (except in cases of immediate threat to life and health) without LFA, State or local Government request for assistance; or (5) For nonradiological emergencies. 10. RADIOLOGICAL ASSISTANCE PLANNING AND READINESS. a. FRMAC Operations. (1) FRMAC shall assure the technical integrity of the environmental data and maintain an accountable database of all offsite environmental data, provide exposure rate, isotope concentrations, and projected dose contours for the affected areas, and any other assessments requested by the States, tribes, or the LFA.
