U.S. Department of Energy ORDER Washington, D.C. DOE 1360.4B 12-31-91 SUBJECT: SCIENTIFIC AND TECHNICAL COMPUTER SOFTWARE 1. PURPOSE.To prescribe Department of Energy (DOE) policies andprocedures pertaining to the management and control of scientific andtechnical computer software which has been developed with DOE funds. 2. CANCELLATIONS. a. DOE 1360.4A, SCIENTIFIC AND TECHNICAL COMPUTER SOFTWARE, of 10-7-87. b. DOE N 1360.8, APPROVAL PROCESS FOR SOFTWARE REQUESTS FROM SENSITIVE COUNTRIES, of 1-15-91. 3. SCOPE.The provisions of this Order apply to all Departmental Elementsand to contractors performing work involving the development ofscientific and technical computer software programs as set forth orreferenced in a contract, or transmitted by the contracting officer forcompliance in accordance with a contract provision or other agreement. 4. COVERAGE. a. This Order addresses scientific and technical computer software programs developed and/or modified during work supported by DOE or during work carried out for others at DOE facilities that have been provided by the developer to others for their use, or that have potential application to DOE or others outside the Department. It includes computer software programs which have been released to the contractor for commercialization purposes under the technology transfer mission of the DOE, and controlled scientific and technical computer software, such as Unclassified Controlled Nuclear Information, Small Business Innovation Research, Applied Technology, and other sensitive information identified in DOE 1430.2A. b. This Order also identifies approval procedures for handling requests from sensitive foreign countries for scientific, technical, or technology-related computer software programs developed by or for DOE. c. This Order does not address management of the software development itself. 5. EXCLUSIONS.Excluded from the provisions of this Order are: a. Software generated under the auspices of the Energy Information Administration; b. Operational systems software, necessary to ensure the fundamental operability of automated data processing equipment, whether supplied by the manufacturer of the system hardware or others and whether or not proprietary, which is not covered under a commercialization or copyright release request; and c. Computer software programs developed and/or modified during work carried out for others at DOE facilities specifically excluded in the agreement under which the non-DOE funded work was performed. d. The specific software used by Bonneville Power Administration (BPA) for the operation, control, planning and modeling of the Northwest electric power transmission system and the interconnected utilities.However, modification/enhancements to portions of this software which are not an integral part of the whole and have potential application to other DOE programs or outside DOE are not excluded. 6. REFERENCES. a. DOE 1240.2A, UNCLASSIFIED VISITS AND ASSIGNMENTS BY FOREIGN NATIONALS, of 1-19-89, which establishes authorities, responsibilities, and policies and to prescribe administrative procedures for visits and assignments by foreign nationals to DOE facilities for purposes involving unclassified matter. b. HQ 1324.1A, RECORDS MANAGEMENT, of 6-8-87, which establishes policies, responsibilities, and procedures for the implementation of the Headquarters Records Management Program.

DOE 1324.2A, RECORDS DISPOSITION, of 9-13-88, which establishes policies, procedures, standards, and guidelines for the orderly disposition of records of DOE and its management and operating contractors. d. DOE 1324.6, AUTOMATED OFFICE ELECTRONIC RECORDKEEPING, of 7-8-87, which establishes requirements for managing electronic records: records created, stored, or transmitted using personal computers, word processors, and associated electronic office equipment. e. DOE 1330.1C, COMPUTER SOFTWARE MANAGEMENT, of 1-12-90, which establishes policies and responsibilities for computer software management. f. DOE 1360.1A, ACQUISITION AND MANAGEMENT OF COMPUTING RESOURCES, of 11-15-90, which establishes Departmental policies and procedures for the acquisition and management of computing resources. g. DOE 1360.2A, UNCLASSIFIED COMPUTER SECURITY PROGRAM, of 5-20-88, which establishes requirements, policies, responsibilities, and procedures for developing, implementing, and sustaining a DOE unclassified computer security program. h. DOE 1360.3B, AUTOMATIC DATA PROCESSING STANDARDS, of 11-15-90, which establishes responsibilities and policies for the implementation of Government-wide ADP standards and for the development and implementation of Department-wide ADP standards. i. DOE 1430.1B, MANAGEMENT OF SCIENTIFIC AND TECHNICAL INFORMATION, of 7-19-91, which defines the policies, objectives, and responsibilities for management of DOE's scientific and technical information. j. DOE 1430.2A, SCIENTIFIC AND TECHNICAL INFORMATION PROGRAM, of 12-14-87, which establishes the implementation procedures for the Department's scientific and technical information program. k. DOE 1430.3, POLICY FOR THE DISSEMINATION OF AND ACCESS TO DEPARTMENTAL UNCLASSIFIED SCIENTIFIC AND TECHNICAL INFORMATION, of 12-24-86, which establishes a framework for DOE policy concerning dissemination of and access to all unclassified scientific and technical information developed for or on behalf of DOE. l. DOE 1500.3, FOREIGN TRAVEL AUTHORIZATION, of 11-10-86, which establishes policies and procedures governing official and unofficial foreign travel. m. DOE 5635.1A, CONTROL OF CLASSIFIED DOCUMENTS AND INFORMATION, of 2-12-88, which provides guidance on safeguarding and controlling classified documents and information, and implements the requirements of Executive Order 12065 and the Atomic Energy Act of 1954, as amended. n. DOE 5635.4, PROTECTION OF UNCLASSIFIED CONTROLLED NUCLEAR INFORMATION, of 2-3-88, which establishes DOE policies and procedures for the protection of Unclassified Controlled Nuclear Information (UCNI). o. DOE 5637.1, CLASSIFIED COMPUTER SECURITY PROGRAM, of 1-29-88, which establishes uniform requirements; policies, responsibilities, and procedures for the development and implementation of a Department of Energy (DOE) Classified Computer Security Program to ensure the security of classified information in Automated Data Processing (ADP) systems. p. DOE 5650.3, IDENTIFICATION OF UNCLASSIFIED CONTROLLED NUCLEAR INFORMATION, of 2-29-88, which establishes policies and procedures for identifying UCNI and for reviewing and marking documents and material containing UCNI. q. Acquisition Letter 91-7, of 12-4-91, which provide policy guidance, and an implementing contract clause, governing data and computer software rights under those management and operating (M&O) contracts that include a technology transfer clause implementing the National Competitiveness Technology Transfer Act (NCTTA) of 1989.

r. Atomic Energy Act of 1954, as amended, 42 United States Code 2011-2296, which establishes procedures for controlling atomic energy information. s. Energy Science and Technology Software Center (ESTSC) Guide for Submitting and Ordering Software, ESTSC-1, of December 1991, which provides guidelines for preparing, submitting and requesting software packages from the ESTSC. t. Office of Management and Budget Circular No. A-130, "Management of Federal Information Resources," of 12-24-85, which establishes a policy framework for management of Federal information resources. u. Public Law 95-242, The Nuclear Nonproliferation Act of 1978, of 3-10-78, which provides for more efficient and effective control over the proliferation of nuclear explosive capability. v. Public Law 96-511, 44 U.S.C. 101, Paperwork Reduction Act of 1980, which, among other purposes, provides for reducing paperwork and enhancing the economy and efficiency of the Government and the private sector by improving Federal information policy making. w. Title 10 Code of Federal Regulations (CFR) 600, Department of Energy Financial Assistance Rules, of 10-5-82, as amended, which establishes policies and procedures for awarding and administering DOE grants and cooperative agreements. x. Title 15 CFR 768-799, U.S. Export Administration Regulations (EAR), which implements the Export Administration Act of 1979, as amended. y. Title 17 U.S.C. Chapter 4, Copyright Notice, Deposit, and Registration, sections 401 and 402, which describe the provisions for establishing notice of copyright. z. Title 22 CFR 121-130, Revision of the International Traffic in Arms Regulations (ITAR), of 12-6-84, which implements the Arms Export Control Act (22 U.S.C. 2728). aa. Title 41 CFR 201, Federal Information Resource Management Regulation (FIRMR), of October 1990 edition, Section 201-24.201, Federal Software Exchange Program, which provides policy and procedures describing the Federal Software Exchange Program, the reporting of common-use ADP software to the Federal Software Exchange Center, and subsequent use of this information for Government-wide sharing. bb. Title 48 CFR, 9, Department of Energy Acquisition Regulation (DEAR), which implements and supplements the "Federal Acquisition Regulation" (FAR) in relation to Departmental procedures. cc. Title 48 CFR, 27, Federal Acquisition Regulation (FAR), "Patents, Data, and Copyrights," of 1990 edition, as amended, which is the uniform, Government-wide regulation concerning patents, data, and copyrights in Government contracting. dd. Title 48 CFR 927, Department of Energy Acquisition Regulation (DEAR), "Patents, Data, and Copyrights," of 3-28-84, which implements and supplements the FAR. 7. DEFINITIONS. a. Collaborative Efforts.For the purposes of this Order, collaborative efforts are software creation or enhancement efforts which involve two or more individuals (organizations) during the development stage of the software.Performing organizations are encouraged to develop an organization-wide policy on collaborations that meets DOE software development policies and sensitive country requirements. b. Commercial Computer Software Package.Scientific and technical computer software which has been released to the contractor for commercialization purposes under DOE's technology transfer program. Exclusive rights to the copyrighted work are granted to the contractor with the Government retaining certain rights as set forth in Acquisition Letter 91-7.

c. Contractor.A party to a contract (excluding small purchases), cooperative agreement, grant, or funds-out interagency acquisition during which DOE funds are used to create scientific or technical computer software. d. Energy Science and Technology Software Center (ESTSC).The centralized software management activity operated under contract for the Department of Energy, located at P.O. Box 1020, Oak Ridge, TN 37831.Specific activities of the Center include:collection, review, compilation, sample problem testing, storage, and appropriate announcement and dissemination of DOE-sponsored scientific and technical computer software. e. Office of Scientific and Technical Information (AD-21).The Office of Scientific and Technical Information coordinates policies and provides direction for the Department's cross-cutting scientific and technical information program and furnishes a centralized base of support to assist Departmental Elements in managing their scientific and technical information, which includes software. AD-21 maintains a DOE facility for the collection, control, processing, announcement, dissemination, and historical referencing of scientific-and technical information resulting from DOE's programmatic activities, and provides a variety of technical information support activities.AD-21 has oversight responsibility for the Energy Science and Technology Software Center, the central activity for managing DOE's scientific and technical computer software. f. Scientific and Technical Computer Software.Software developed for DOE or others at DOE facilities that consists of computer programs and routines, and includes subroutines, related groups of routines, single programs, and sets or systems of programs. Computer software packages consist of these elements plus supporting material. g. Sensitive Countries.Foreign countries which are given particular consideration for policy reasons during the dissemination approval process.Countries may be considered sensitive for reasons of national security, nuclear nonproliferation, regional instability, or terrorism support, and are listed in DOE 1240.2A and DOE 1500.3. h. Specialized Information Analysis Centers (SIAC).Those Headquarters sponsored activities that collect, evaluate, announce, and provide scientific and technical computer software in specialized subject areas.These centers complement but do not duplicate the activities of the ESTSC and are established by Heads of Departmental Elements with the concurrence of AD-21.The sole purpose of an SIAC is to provide direct specialized scientific and technical expertise to meet a specific programmatic need.For the purposes of this Order, the Centers and their areas of responsibility are identified in Attachment 1. i. Supporting Material.Additional information and material necessary to use and run scientific and technical computer software, such as the minimum support documentation (i.e., a single comprehensive report or published paper reprints, program reports, users manuals, technical manuals, program maintenance manuals, installation memoranda, and computer output listings), data libraries, copies of sample problems, and other machine readable media.8.POLICY.Scientific and technical computer software programs developedfor modified during work supported by DOE or during work carried outfor others at DOE facilities that have potential usefulness to othersmust be provided to the ESTSC for inclusion in DOE's informationannouncement and dissemination systems and, when appropriate, fordissemination outside the Department.Such software shall be madeavailable to the s c i e n t i f i c , technical, academic, and industrialcommunities, and to the public, only through approved channels (e.g.,the SIACs) as security, patent, contractual, and other DOE policyconsiderations permit.

9. OBJECTIVES. a. To ensure that DOE scientific and technical computer software is managed consistent with laws, regulations and DOE policies. b. To systematically report, control, and manage scientific and technical computer software as defined in this Order. c. To manage scientific and technical computer software in such a manner as to: support the needs of Departmental Elements; safeguard national security; and promote U.S. competitiveness and educational objectives. 10. RESPONSIBILITIES. a. Director, Office of Administration and Human Resource Management (AD-1), in consultation with the Heads of Departmental Elements, establishes policy for the management of DOE computer software. In conjunction with this responsibility, as the single agency official for information resources management, AD-1 shall, through the Director, Office of Scientific and Technical Information, AD-21, develop policy and procedures for the management of scientific and technical computer software. b. Assistant Secretary for Defense Programs (DP-1). (1) Through the Director, Office of Arms Control andNonproliferation Technology Support (DP-5), reviews requestsfrom sensitive countries for DOE software.DP-5 will providea recommendation for approval or denial of each softwarerequest within 20 days of receipt of the information packagedescribed in 10h(14) to the Director, Office of InternationalResearch/Development Policy (IE-12) and AD-21. (2) Ensures that appropriate Orders and guidance are issued toallow for the identification and control of scientific andtechnical computer software which is subject to exportcontrols or other software bearing on national security andforeign policy. c. Assistant General Counsel for Intellectual Property (GC-42). (1) Reviews and responds to notifications of intent to copyrightand requests for permission to assert copyright, and controlsrelease of copyright to scientific and technical computersoftware consistent with applicable statutes, laws,regulations, and Departmental policy. (2) Approves licenses, and other such agreements involvingnon-copyrighted scientific and technical computer software. (3) Makes legal determinations of DOE's rights regardingscientific and technical computer software and handles claimsinvolving proprietary and commercial computer software. (4) In conjunction with contracting officers, ensures thatapplicable provisions of the data rights clause and/or relatedprovisions are included in contracts and subcontracts. d. Assistant Secretary for International Affairs and Energy Emergencies (IE-1). (1) Advises program offices as to what scientific and technicalcomputer software received through international agreementsshould be subject to dissemination controls. (2) Determines whether dissemination of scientific and technicalcomputer software packages to particular foreign countries iscompatible with U.S. foreign policy. (3) Assures that those international agreements for exchange ofcomputer software to which DOE or one of its subordinateentities is party, conform to DOE and U.S. foreign policies. (4) In conjunction with program offices, assures that scientificand technical computer software exchanges conducted undersuch international agreements are equitable from a foreignpolicy standpoint. (5) Through IE-12, reviews requests from sensitive

countries forDOE software and coordinates with the State Department, asneeded.IE-12 will notify AD-21 of the approval or denial ofeach software request within 45 days of receipt of theinformation package described in 10h(14) below.Nodissemination will be made to sensitive countries withoutIE-12 approval. e. Director, Office of Intelligence (IN-1).Executive Orders 12333 and 12356 establish special requirements for the use, handling, and protection of intelligence within the United States Government. In accordance with these requirements, Secretary of Energy Notice SEN-6B establishes the Director of the Office of Intelligence (IN-1) as the coordinator for all DOE intelligence-related activities, including those performed as work for others.These responsibilities include information security and information control policies for intelligence.Therefore, IN-1 ensures that appropriate policies and procedures are issued for the proper handling, safeguarding and accountability of foreign intelligence information, including intelligence-related software.If IN-1 determines software to be appropriate for further announcement or dissemination, they will supply such software and supporting materials to AD-21 with appropriate instructions. f. Deputy Assistant Secretary for Naval Reactors (NE-60).Executive Order 12344, statutorily prescribed by P.L. 98-525 (42 U.S.C. 7158, note), establishes the responsibilities and authorities of the Director, Naval Nuclear Propulsion Program (who is also the Deputy Assistant Secretary for Naval Reactors within the Department), over all facilities and activities which comprise the Program, a joint Navy-DOE organization.These responsibilities include information security and information control policies for the Program.Therefore, the provisions of this Order do not apply to NE-60.If NE-60 determines software to be appropriate for further announcement or dissemination, they will supply such software and supporting materials to AD-21 with appropriate instructions. g. Director, Office of Security Affairs (SA-1), ensures that appropriate Orders and guidance are issued to allow for the identification and control of scientific and technical computer software which contains classified or Unclassified Controlled Nuclear Information (controlled under Section 148 of the Atomic Energy Act of 1954, as amended). h. Heads of Headquarters Elements and Field Organizations.(1)In consultation with AD-1, participate in the development,implementation, and evaluation of policies for managingscientific and technical computer software. (2) Ensure that any SIAC under their purview submits softwaresummaries (abstracts and related bibliographic data) to andcoordinates distribution activities with AD-21 to ensureconsistent implementation of DOE policies and procedures.Dissemination to sensitive countries must be coordinatedthrough AD-21, and approved by IE. (3) Examine the ESTSC database, announcements, or publications ofsoftware holdings to determine the availability of existingsoftware which could satisfy the users needs as required byDOE 1330.1C prior to development of new scientific andtechnical computer software. (4) Ensure that Departmental Elements, contractors, and financialassistance recipients under their purview provide copies ofDOE funded scientific and technical computer software to theESTSC or the appropriate SIAC in accordance with this Orderand the DOE software management submission guidelines.

(5) Shall designate an individual(s) to be responsible forbringing to the attention of the contracting officer eachprocurement falling within the scope of this Order.Unlessanother individual is designated, the responsibility is thatof the procurement request originator (the individualresponsible for initiating a requirement on DOE F 4200.33). (6) Ensure that all scientific and technical computer softwaredeveloped by Departmental Elements, contractors, and financialassistance recipients under their purview, contain thefollowing statements on the cover and title page of alldocumentation developed for that software, and anycomputer-readable medium used for transmitting that software: DISTRIBUTION STATEMENT (a) "This computer software has been developed undersponsorship of the Department of Energy.Any furtherdistribution by any holder of this software package orany data contained therein outside of DOE offices orother DOE contractors, unless otherwise specificallyprovided for, is prohibited without the approval of theDOE Energy Science and Technology Software Center.Requests from outside the Department for DOE-developedcomputer software shall be coordinated with the EnergyScience and Technology Software Center, P.O. Box 1020,Oak Ridge, TN 37831."DISCLAIMER (b) "This material was prepared as an account of worksponsored by an agency of the United States Government.Neither the United States nor the United StatesDepartment of Energy, nor any of their employees, makesany warranty, express or implied, or assumes any legalliability or responsibility for the accuracy,completeness, or usefulness of any information,apparatus, product, or process disclosed, or representsthat its use would not infringe privately owned rights." The disclaimer may or may not be appropriate for DOE-generatedsoftware.It is the responsibility of each DOE site todetermine the appropriate notice for the software itgenerates.Such decisions should be coordinated with theappropriate legal counsel.Appropriate additional markingsshould be affixed and consistent with restrictions indicatedon the submittal form and/or all software package elementsprovided to the ESTSC or an SIAC. (7) Ensure that all commercial computer software packages whichhave been released to the contractor for commercializationpurposes under the technology transfer mission of the DOEhave the applicable copyright notice of 17 U.S.C. 401 or 402on the copyrighted work and also an acknowledgment of theGovernment sponsorship and license rights as set forth inAcquisition Letter 91-7, or as set forth in the "rights intechnical data" clause of the prime contract. (8) Ensure that for each commercial computer software package thecontractor provides the following to the ESTSC fordissemination in accordance with the Government's rights inthe software: (a) An abstract, suitable for publication, describing thesoftware; (b)The machine readable source code; and (c)The object code and at least the minimum supportdocumentation needed by a technically competent user tounderstand and use the software. (9)Ensure that dissemination of scientific and technical computersoftware outside the originating organization, the Department,and its contractors, is through the ESTSC or, when authorized,the appropriate SIAC, only, unless there are patent,copyright, pre-approved international or collaborativeexchange agreements, or other authorized exceptions.Requestsfrom outside the Department (other than as noted above) forDOE-developed scientific and technical computer software shallbe referred to the ESTSC. A contractor organization may release scientific and technicalcomputer software directly to small numbers of peer groupmembers within DOE and DOE contractor organizations providedthat the recipients have been approved by the

originator'ssupervisor and the organization meets the criteria defined in10h(10) below. (10) Ensure that each contractor establishes a scientific andtechnical computer software management function that developsand manages internal procedures that result in: (a)The ESTSC obtaining copies of all software subject todissemination as specified in 10h(4) of this Order. (b)Control of software from a classification, nationalsecurity, sensitive country, programmatic and softwarecommercialization perspective as specified in 10h(13) ofthis Order. (c)Control and approval of software collaborative effortsas specified in 7a of this Order to ensure thatorganizational policy on collaboration and/or DOE policyfor software dissemination are met.When the softwareis at the stage where non-collaborators can use it,further dissemination shall be as specified in 10h(9) ofthis Order. (d)Proper marking of developed software as specified in10h(6) of this Order. This activity is subject to post audit by the cognizant Departmental Element and/or AD-21. (11) Ensure that scientific and technical computer software with ageneral utility, subject to wide interest, or which hasimportant specialized functions, is clearly identified whensubmitted to the ESTSC to ensure priority processing of thesoftware. (12) Ensure that requests for exceptions to requirements in thisOrder, not based on patent, copyright, or contractualprovisions, are submitted to AD-21 for approval aftercoordination with cognizant Headquarters organizations. (13) Ensure that mechanisms are in place for the adequate trainingof staff members to ensure: (a)Appropriate review of scientific and technical computersoftware or supporting documentation from a disseminationcontrol standpoint (see DOE 1430.1B); (b)Appropriate distribution control instructions areincluded in all scientific and technical computersoftware packages provided to the ESTSC; and (c)Proprietary and other sensitive information itself isnot contained in prepared software submittaldescriptions. (14) Ensure that all requests for DOE software packages fromsensitive countries, listed in DOE Orders 1240.2A and 1500.3,are forwarded to AD-21.No dissemination will be made tosensitive countries without written DOE approval by IE-12.The following information shall be transmitted to AD-21: (a)A brief description of each software program requested; (b)Name, organization, and address of requester; (c)A copy of the original software request; and (d)A copy of the abstract of the software package beingrequested in the format described in the guidelines forsubmitting software to the ESTSC. i. Procurement request originators (the individuals responsible for initiating a requirement on DOE F 4200.33, "Procurement Request Authorization") or other individual(s) as designated by the cognizant heads of Headquarters elements or field organizations shall bring to the attention of the cognizant contracting officer the following:(1) each procurement requiring the application of this Order; (2) requirements for flowdown or provisions of this Order to any subcontract or sub-award; and (3) identification of the paragraphs of other portions of this Order with which the awardee, or, if different, a sub-awardee, is to comply. j. Contracting Officers, based on advice received from the procurement request originator or other designated individual shall apply applicable provisions of this Order to awards falling within its scope.For awards other than management and operating contracts, this shall be incorporated or referenced using explicit language in a contractual publication, usually bilateral.

k. Director, Office of Information Resources Management (AD-20), through the Director, Office of Scientific and Technical Information (AD-21), shall: (1)Provide guidance and direction for the management ofDOE-funded scientific and technical computer software. (a)Coordinate the development of scientific and technicalcomputer software policy and participate in the reviewand analysis of related legislation and issues fordetermining Departmental implications. (b)Maintain a system for announcement and dissemination ofDOE-funded scientific and technical computer software. (2)Coordinate the approval process for software requests fromsensitive countries. (a)Maintain a database of software requests received fromsensitive countries for use in tracking the reviewprocess, and the resultant approval/denial decision. (b)Coordinate with program offices having special knowledgeof the software requested as appropriate.Any computersoftware programs under the cognizance of Naval ReactorsProgram (NE-60, or its contractors) must be reviewed andconcurred in by NE-60 prior to AD-21 submission toIE-12. (c)Notify the submitting sites or SIAC of the IE-12approval/denial decision within 45 days of receipt ofthe request.The ESTSC or the SIAC will provide thesoftware package to the requester or notify the requesterof the denial. (3)Develop and provide guidelines to DOE organizations andcontractors responsible for submitting software to the ESTSC. (4)Provide assistance to the cognizant programmatic SecretarialOffices, in development, coordination, and administration ofagreements with other countries and internationalorganizations that specifically include the exchange ofscientific and technical computer software in consultationwith the Assistant Secretary for International Affairs andEnergy Emergencies (IE-1) and the Department of State, asappropriate. (5)Serve as the central contact on matters relating toinformation management of scientific and technical computersoftware. 11. ASSISTANCE.Questions pertaining to scientific and technical computersoftware management policy should be directed to the Office ofScientific and Technical Information (AD-21, FTS 626-1166).
