CANCELE D DISTRIBUTION: INITIATED BY: All Departmental Elements Office of Human Resources and Administration DOE N 251.33 U.S. Department of Energy NOTICE Washington, D.C. 08-06-98 Expires: 11-06-98 SUBJECT: CANCELLATION OF DIRECTIVE Effective immediately, DOE 1100.4, ORGANIZATION AND FUNCTIONS -- BOARD OF CONTRACT APPEALS, dated 3-1-79 is canceled. On April 13, 1998, DOE 1100.4 was temporarily reinstated to eliminate the public confusion about the Board’s jurisdiction over cases brought under the Contract Disputes Act of 1978. The Chairman of the Board of Contract Appeals and the Office of General Counsel have codified its relevant sections in 10 CFR Parts 703 and 1023, and Amendment No. 1 to Delegation Order No. 0204-162. Therefore, both offices recommend that DOE 1100.4 be canceled. Cancellation of a directive does not, by itself, modify or otherwise affect any contractual obligation to comply with such a directive. Canceled directives that are incorporated by reference in a contract shall remain in effect until the contract is modified to delete the reference to the requirements in the canceled directive.
