INNOVATION)
ASSISTANT SECRETARY FOR FOSSIL ENERGY AND
CARBON MANAGEMENT

SUBJECT: Delegation of Authority to Administer Programs Authorized by
Sections 969A and 969D of the Energy Policy Act of 2005 (42
U.S.C. 16298a and 16298d), as amended by Sections 40302,
40308, and 41005 of Infrastructure Investment and Jobs Act
(IIJA), Public Law 117-58
Under the authority vested in me as Secretary of Energy and pursuant to section 642 of
the Department of Energy Organization Act (Public Law 95-91, 42 U.S.C. 7252), I
delegate to the Under Secretary for Science (and Innovation) and the Assistant Secretary
for Fossil Energy and Carbon Management, the authority to take the following actions:
1. Under the Energy Policy Act of 2005 (Public Law 109-58), execute all activities
necessary to carry out under section 969A (42 U.S.C. 16298a) a program of research,
development, and demonstration for carbon utilization.
2. Under the Energy Policy Act of 2005 (Public Law 109-58), execute all activities
necessary to carry out under section 969D (42 U.S.C. 16298d) a research,
development, and demonstration program to test, validate, or improve
technologies and strategies to remove carbon dioxide from the atmosphere on a
large scale in coordination with other DOE offices and Federal agencies as
appropriate.
Except as expressly prohibited by law, regulation, or this memorandum, the Under
Secretary for Science (and Innovation) and the Assistant Secretary for Fossil Energy and
Carbon Management may delegate this authority further, in whole or in part.
