HOFFMAN ACTING DIRECTOR GRID DEPLOYMENT OFFICE FROM: JENNIFER M. GRANHOLM SUBJECT: Delegation of Authority for Hydroelectric Efficiency Improvement Incentives and Maintaining and Enhancing Hydroelectricity Incentives, as contained in the Energy Policy Act of 2005, as amended by the Infrastructure Investment and Jobs Act authorized by Sections 40332 and 40333 of the Infrastructure Investment and Jobs Act, Public Law 117-58, signed November 15, 2021 Section 243 of the Energy Policy Act of 2005 (EPAct 2005), as amended by section 40332 of the Infrastructure Investment and Jobs Act (IIJA) and codified at 42 U.S.C. 15882, establishes a program for “Hydroelectric Efficiency Improvement Incentives.” Section 247 of EPAct 2005, as added by section 40333 of the IIJA and codified at 42 U.S.C. 15883, establishes a program for “Maintaining and Enhancing Hydroelectricity Incentives.” I hereby delegate to the Under Secretary for Infrastructure, the Principal Deputy Under Secretary for Infrastructure, and the Director, Grid Deployment Office, authority to take the following actions: Administer the Hydroelectric Efficiency Improvement Incentives program under section 243 of EPAct 2005, as amended by section 40332 of the IIJA, including making 1. incentive payments to the owners or operators of hydroelectric facilities at existing dams. DOE Delegation No. S1-DEL-S3GD1-2022-2 Administer the Maintaining and Enhancing Hydroelectricity Incentives program under section 247 of EPAct 2005, as added by section 40333 of the IIJA, including making 2. incentive payments to the owners or operators of qualified hydroelectric facilities for capital improvements directly related to improving grid resiliency, improving dam safety, and environmental improvements. Both these authorities may be redelegated as appropriate.
