DEPARTMENT OF ENERGY DELEGATION ORDER NO. S1-DEL-HDEs-2022 TO THE DEPUTY SECRETARY, UNDER SECRETARIES, AND HEADS OF DEPARTMENTAL ELEMENTS 1. DELEGATION. Under the authority vested in me as Secretary of Energy and pursuant to section 642 of the Department of Energy Organization Act (Public Law 95-91, 42 U.S.C. 7252), I delegate to the Deputy Secretary, Under Secretaries, and Heads of Departmental Elements (HDEs) the authority to approve evacuation and special allowance payments for qualified Federal employees and their dependents who are evacuated away from their homes because of a natural disaster or for other reasons that pose imminent danger to their lives as provided by 5 C.F.R. § 550.401 et.seq. This authority may be redelegated. 1.1 Special allowance payments include travel, lodging, and subsistence for employees and their dependents who are evacuated to a safe haven within the United States. A dependent is defined as a relative of the employee residing with the employee and dependent on the employee for support. Evacuation payments are to be made in accordance with the Federal Travel Regulation (FTR), Chapter 301, Temporary Duty (TDY) Travel Allowances. 1.2 Evacuation and special allowance payments are not an entitlement. During an evacuation, employees may be provided special allowances, to include travel expenses and per diem, to offset any direct added expenses incurred by the employee or his or her dependents as a result of the evacuation. Additionally, employees may be provided advance payment of pay, allowances, and differentials during the evacuation for a period of time not to exceed 30 days and may be provided evacuation payments for a period not to exceed 180 days. An advance payment or an evacuation payment may be paid to the employee, or to any dependent 16 years of age or older, or to a designated representative, so long as a prior written authorization authorizing other persons to receive payment has been provided by the employee to the authorizing official in the Department. Lastly, any advance payment made to or for the account of an employee shall in no way diminish the amount of evacuation payments that would otherwise be due to that employee. 1.3 While remaining mindful of mission needs as well as human resources and budget constraints, prior to the approval of any evacuation and special allowance payments, the delegates, must consult with the appropriate budget and human capital offices and ensure compliance with all relevant Federal regulations. 2. LIMITATION. 3.1 In exercising the authority delegated in this Order, a delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary. 3.2 Nothing in this Order precludes the Secretary from exercising any of the authority delegated by this Order. 3.3 Nothing in this Order shall be construed to supersede or otherwise interfere with the authorities provided to the Administrator for Nuclear Security by law or delegation. Furthermore, nothing herein constitutes authority to exercise authority, direction, or control of an employee of the National Nuclear Security Administration or its contractors. 3.4 Any amendments to this Order shall be made in consultation with the Department of Energy General Counsel. 4. AUTHORITY TO REDELEGATE. 4.1 Except as expressly prohibited by law, regulation, or this Order, the Deputy Secretary, Under Secretaries, or HDEs may delegate this authority further, in whole or in part. 4.2 Copies of this delegation, redelegations, and any subsequent redelegations shall be provided to the Office of Management, which manages the Secretarial Delegations of Authority system. 5. DURATION AND EFFECTIVE DATE. 5.1 All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended or superseded. 5.2 This Delegation Order is effective _______________. _________________ Jennifer M.
