NATIONAL NUCLEAR SECURITY ADMINISTRATION DELEGATION ORDER NO. NA-2023-NA1-NAESH-01 TO THE ASSOCIATE ADMINISTRATOR FOR ENVIRONMENT, SAFETY, AND HEALTH DELEGATION. Under the authority vested in me as the Administrator of the National Nuclear Security Administration (NNSA), pursuant to section 3212 of the National Nuclear Security Administration Act (50 U.S.C. 2402) and Department of Energy (DOE) Order 442.2, Differing Professional Opinions for Technical Issues Involving Environmental, Safety, and Health Technical Concerns, | delegate the authority to assign a Final Decision Manager for each NNSA Differing Professional Opinion (DPO) as well as assigning NNSA DPO Managers and alternates, to Ahmad M. Al-Daouk, Associate Administrator for Environment, Safety, and Health. RESCISSION. Delegation Order No. S5-DEL-NA50-2016 is hereby rescinded. LIMITATIONS. 3.1. This Delegation Order covers only NNSA safety-related matters. 3.2. In exercising the authority delegated in this Delegation Order, the delegate shall be governed by the rules and regulations of the DOE/NNSA, and the policies and procedures prescribed by the Secretary and the Under Secretary for Nuclear Security/ Administrator. 3.3. Nothing in this Delegation Order precludes the Under Secretary for Nuclear Security/ Administrator from exercising any of the authority delegated by this Delegation Order. 3.4. | Nothing in this Delegation Order shall be construed to supersede or otherwise interfere with the authorities provided to the NNSA Administrator by law or delegation. 3.5. Any amendments to this Delegation Order shall be made in consultation with the NNSA General Counsel. CONDITIONS. 4.1. NNSA DPO Final Decision Manager must be an NNSA Senior Technical Safety Manager qualified to DOE-Standard-1175, Senior Technical Safety Manager Functional Area Qualification Standard. 4.2. NNSA DPO Final Decision Manager must be at a level above or independent from the manager who made the contested decision. 4.3. Suitable alternate DPO Managers may include other NNSA DPO Managers, including DPO Managers within the same organization or in other organizations. AUTHORITY TO REDELEGATE. This delegation may not be re-delegated. DURATION AND EFFECTIVE DATE. 6.1. 6.2. 6.3. All actions pursuant to any authority delegated prior to this Delegation Order or any authority delegated pursuant to previous delegations, taken prior to and in effect on the date of this Delegation Order, are ratified and remain in force as if taken under this Delegation Order; unless or until rescinded, amended, or superseded. A copy of the final signed Delegation Order will be sent to the NNSA Otttice of Policy and Strategic Planning, NNSA Directives Team.
