IA-DEL-RTES-2025, Redelegation to the Director of the Office of Research, Technology, and Economic Security (RTES)

1. DEPARTMENT OF ENERGY REDELEGATION ORDER NO. IA-DEL-RTES-2025 TO THE DIRECTOR, OFFICE OF RESEARCH, TECHNOLOGY, AND ECONOMIC SECURITY DELEGATION. Under the authority vested in me as the Assistant Secretary for International Affairs and pursuant to section 642 of the Department of Energy Organization Act (Public Law 95-91, 42 U.S.C. 7252), I delegate to the Director of the Office of Research, Technology, and Economic Security (RTES) authority to take the following actions, subject to sections 3.1-3.6:1 1.1 In reference to the Research and Development, Competition, and Innovation Act, also known as the CHIPS and Science Act (Public Law 117-167) ("the Act"), execute all activities necessary to implement the research security requirements and responsibilities assigned to the Secretary pursuant to sections 10114 and 10632-10634 of the Act (42 U.S.C. 18912, 19232-19234). The RTES Director shall serve as the designated Departmental officer "responsible for tracking and notifying recipients of any covered support of unmanageable threats to United States national security or of theft or loss of United States intellectual property posed by an entity of concern," as required under section 10114(b)(2)(C) of the Act (42 USC 18912(b)(2)(C)). 1.2 Execute all activities necessary to implement the research security requirements assigned to agency heads in National Security Presidential Memorandum 33 (NSPM-33) to strengthen protections of United States Government-supported research and development from foreign government interference and exploitation. 1.3 Implement the prohibition on use of funds made available by the Consolidated Appropriations Act, 2024 to an entity of concern as described in section 310 of such Act (Public Law 118-42). 1.4 Execute all activities necessary to implement the requirements assigned to agency heads in section 223 of the .National Defense Authorization Act for Fiscal Year 2021 (Public Law 116-283; 42 u.s.c. 6605). 2 .0 RESCISSION. None. 3.0 LIMITATIONS. 3.1 This delegation is not applicable to the DOE labs, sites and facilities and does not convey program or procurement authorities to the RTES Director. 1 This delegation is intended to provide the RTES Director with authority to perform its assigned functions, e.g., due diligence reviews and risk assessments, mitigations, and outreach, consistent with memoranda from the Deputy Secretary and the Office of the Secretary, and current taskings. Memorandum from the Deputy Secretary, "Department of Energy Research, Technology, and Economic Security Policy Working Group," January 26, 2024; Memorandum from the Chief of Staff to the Secretary, "Department of Energy Research, Technology and Economic Security Vetting Center," March 1, 2023. 3.2 This delegation includes authorities relating to Departmental reviews and mitigations for research, technology, and economic security, as identified in Section 1 above. The RTES Office makes recommendations to DOE based on such reviews to inform DOE decisions and execution of DOE authorities for procurement and other programmatic and management activities. 3.3 In exercising the authority delegated in this Order, a delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary. 3.4 Nothing in this Order precludes the Secretary from exercising any of the authority delegated by this Order. 3.5 Nothing in this Order shall be construed to supersede or otherwise interfere with the

authorities provided to the Undersecretary for Nuclear Security by law or delegation. Furthermore, nothing herein constitutes authority to exercise authority, direction, or control of an employee of the National Nuclear Security Administration or its contractors. 3.6 Any amendments to this Order shall be made in consultation with the Department of Energy's Office of the General Counsel. 4.0 AUTHORITY TO REDE LEGATE. 4.1 Except as expressly prohibited by law, regulation, or this Order, the RTES Director may delegate this authority further, in whole or in part. 4.2 Copies of this delegation, redelegations, and any subsequent redelegations shall be provided to the Office of Management, which manages the Secretarial Delegations of Authority system. 5.0 DURATION AND EFFECTIVE DATE. 5.1 All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended, or superseded. 5.2 This Delegation Order is effective January 17, 2025 2 k�--e And rew Light Assistant Secretary for International Affairs 20250117125845915.pdf 20250117130131466.pdf
