DEPARTMENT OF ENERGY DESIGNATION ORDER NO. GC1-DES-GC20-2021 TO THE DEPUTY GENERAL COUNSEL FOR AGENCY OPERATIONS 1. DESIGNATION. Under the authority vested in me as General Counsel and pursuant to the Federal Tort Claims Act, 28 U.S.C. § 1346(b)(1), and 10 C.F.R. §§ 1014.5 - 1014.7, I hereby designate the Deputy General Counsel for Agency Operations as an employee with the authority to take the following actions: A. For claims where the Department of Energy (DOE) has determined that it is liable, either in whole or part, settle such claims that are no greater than $25,000. B. For claims where DOE has determined that it is liable either in whole or part, refer such settlement of claims that exceed $25,000 to the Department of Justice. 2. RESCISSION. None. 3. LIMITATION. 3.1 This designation covers all parts of DOE, except the Federal Energy Regulatory Commission. 3.2 In exercising the designated authority in this Order, a designee shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary. 3.3 Nothing in this Order precludes the General Counsel or the Principal Deputy General Counsel from exercising any of the authority designated by this Order. 3.4 Nothing in this Order shall be construed to supersede or otherwise interfere with the authorities provided to the Administrator for Nuclear Security by law or delegation. Furthermore, nothing herein constitutes authority to exercise authority, direction, or control of an employee of the National Nuclear Security Administration or its contractors. 3.5 Any amendments to this Order shall be made in consultation with the Department of Energy General Counsel. 4. Lucas Date: 2021.05.07 16:36:10 -04'00' 2 4.1 Except as expressly prohibited by law, regulation, or this Order, the Deputy General Counsel for Agency Operations may designate this authority further, in whole or in part. 4.2 Copies of this designation, redesignations, and any subsequent redesignations shall be provided to the Office of Management. 5. DURATION AND EFFECTIVE DATE. 5.1 All actions by the designee pursuant to any authority provided prior to this Order or pursuant to any authority granted by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended or superseded. 5.2 This Designation Order is effective 05/07/2021 .
