DEPARTMENT OF ENERGY REDELEGATION ORDER NO. 00-038.01-01.01 TO THE ARPA-E DEPUTY DIRECTOR FOR TECHNOLOGY 1. DELEGATION. Under the authority vested in me as Deputy Director for Commercialization of the Advanced Research Projects Agency- Energy (ARPA-E) by Delegation Order No. 00-038.008-1 and pursuant to section 5012 of the America COMPETES Act, as amended (42 U.S.C. § 16538), I delegate to the ARPA-E Deputy Director for Technology authority to take the following actions: 1.1 Develop funding criteria and assessing the success of programs through the establishment of technical milestones. 1.2 Administer the Energy Transformation Acceleration Fund (Fund) through awards to institutions of higher education, companies, research foundations, trade and industry research collaborations, or consortia.of such entities, which may include federally-funded research and development centers, for the following: A. Novel early-stage energy research with possible technology applications; B. Development of techniques, processes, and technologies, and related testing and evaluation; C. Research and development of advanced manufacturing processes and technologies for the domestic manufacturing of novel energy technologies; and D. Coordination with nongovernmental entities for demonstration of technologies and research applications to facilitate technology transfer. 1.3 Adopt measures to ensure that, in making awards, program managers adhere to the purposes of subsection 5012(c)(2)(C), which requires ARPA-E to fund projects that accelerate transformational advances in areas that industry by itself is not likely to undertake due to technical and financial uncertainty. 1.4 Designate employees to serve as Program Directors for the programs es~ablished pursuant to the statutory responsibilities for ARPA-E in subsection 5012(e). LIMITATION. 2.1 In exercising the authority delegated in this Order, the delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary or delegate(s). 2.2 Nothing in this Order precludes the Director, Principal Deputy Director, or Deputy Director for Commercialization from exercising any of the authority delegated in this Order. 2.4 Any amendments to this Order shall be made in consultation with the Department of Energy General Counsel. 3. AUTHORITY TO REDELEGATE. 2 3.1 Except as expressly prohibited by law, regulation, or this Order, the ARPA-E Deputy Director for Technology may not redelegate this authority, in whole or in part. 3.2 Copies of redelegations shall be provided to the Office of Management, which manages the Secretarial Delegations of Authority system. 4. DURATION AND EFFECTIVE DATE. 4.1 All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended or superseded. 4.2 This Delegation Order is effective December 18, 2012.
