BACKGROUND: The recently issued Department of Energy Order 413.38 designates Under Secretaries as Acquisition Executives for projects~ S 100 million and < $750 million. It also stipulates that further delegation of this authority to Program Secretarial Officers is allowed. Previously under Department of Energy Order 413.3A, former Under Secretary David Garman delegated acquisition executive authority to the Assistant Secretary for Nuclear Energy for capital asset projects that have a total project cost of less than $400 million. The Office of Engineering and Construction Management requires that such delegations of authority be updated due to the issuance of Department of Energy Order 413.38. Accordingly, I request that you reaffirm this delegation as allowed for by the provisions of the revised order. RECOMENDATION: Sign belqw to approve the requested delegation. DELEGATE TO PETER B.
