DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-133 TO THE UNDER SECRETARY 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy (“Secretary”") and by section 642 of the Department of Energy Organization Act (DOE Act) (Pub. L. No. 95-91), there is hereby delegated on a non-exclusive basis to the Under Secretary: a. The authority vested in me pursuant to Executive Order 10450 (April 27, 1953), to grant waivers for completion of preemployment full field investigations, where such investigations are required before a selected applicant can enter on duty or be assigned by any means to a position which requires such investigations; b. the authority vested in me pursuant to chapter 45, title 5, United States Code, to approve major Departmental honorary awards, except the Secretary's Award; to approve cash awards in excess of those amounts authorized to be approved by Heads of Departmental Elements, except those of other Principals; and to recommend to the Office of Personnel Management cash awards in excess of $10,000; c. the authority vested in me pursuant to chapter 33, title 5, United States Code, to approve the detail of employees to assignments outside the Department. 2. LIMITATION. a. In exercising the authority delegated by this Order, the delegate shall be governed by the rules or regulations of DOE and the policies and procedures prescribed by the Secretary or his delegate. b. Nothing in this delegation shall preclude the Secretary from exercising any of the authority so delegated whenever, in his judgement, the exercise of such authority is necessary or appropriate to administer the functions vested in him. 3. AUTHORITY TO REDELEGATE. The authority delegated to the Under Secretary may not be further delegated. 4. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded. 2 b.
