DEPARTMENT OF ENERGY REDELEGATION ORDER NUMBER 00-024.01 A TO THE DIRECTOR, OFFICE OF SECURITY OPERATIONS OF THE OFFICE OF HEALTH, SAFETY AND SECURITY 1. REDELEGATION. Under the authority vested in me as Chief Health, Safety and Security Officer, under Delegation Order Number 00-024.00B, I redelegate to the Director, Office of Security Operations, Office of Health, Safety and Security, the authority to: 1.1 For Headquarters activities, make determinations of trustworthiness and establish controls to ensure that classified information is used, processed, stored, reproduced, transmitted, and destroyed only under conditions that will provide adequate protection and prevent access by unauthorized persons pursuant to Executive Order 12958, section 4.1 (a) through (i). 1.2 For Headquarters activities, authorize Department employees and contractor employees to cany firearms and make arrests without warrant pursuant to section 161 k. of the Atomic Energy Act of 1954, as amended. 1.3 For Headquarters activities, exercise the authority vested in the Secretary under section 145b. of the Atomic Energy Act of 1954, as amended, to make determinations permitting an individual access to Restricted Data prior to review of completed investigation if such access is clearly consistent with the national interest, subject to the concurrence of the Director, Office of Departmental Personnel Security. 2. RECISSION. Redelegation Order No. 00-024.01 is hereby rescinded. 3. LIMITATION. 3.1 In exercising the authorities redelegated in this Order, a delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary or delegate(s). 3.2 Nothing in this Order precludes the Secretary or the Chief Health, Safety and Security Officer, from exercising any of the authority redelegated by this Order. 3.3 Nothing in this Order shall be construed to supersede or otherwise interfere with the authorities provided to the Administrator of the National Nuclear Security Administration by law or by delegation. Furthermore, nothing herein constitutes authority to exercise authority, direction, or control of an employee of the National Nuclear Security Administration or its contractors. 3.4 Any amendments to this Order shall be in consultation with the Department of Energy General Counsel. 4. AUTHORITY TO REDELEGATE. 4.1 The authorities redelegated under this Order may not be krther delegated. 5. DURATION AND EFFECTIVE DATE. 5.1 All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended, or superseded. 5.2 This Order is effective September I, 2009.
