[RESCINDED][RESCINDED] DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-91 TO THE UNDER SECRETARY Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) and by Section 7 and 19 of the Federal Nonnuclear Energy Research and Development Act of 1974 (Pub. L. No. 93- 577) and Section 642 of the Department of Energy Organization Act (Pub. L. 95-91), there is hereby delegated to the Under Secretary on a non-exclusive basis: 1. all the authorities vested in me under Sections 7 and 19 of the Federal Nonnuclear Energy Research and Development Act; 2. the authority, in connection with the authorities delegated in paragraph 1, to make any related determinations required by the Federal Nonnuclear Energy Research and Development Act, 10 C.F.R. Part 796, “Federal Loan Guarantees for Alternate Fuel Demonstration Facilities,” and any implementing documentation. The authorities delegated in this Delegation Order may be exercised only in furtherance of Department of Energy Solicitation Announcement DE-PS60-81RA50480, including an application referenced in such solicitation from Great Plains Gasification Associates and any amendments thereto. The authority delegated to the Under Secretary by this Order may be redelegated, in whole or part, as may be appropriate. In exercising the authority delegated by this Order or as redelegated pursuant thereto, the delegate(s) shall be governed by the rules and regulations of DOE and the policies and procedures prescribed by the Secretary or his delegate(s). All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded. Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his judgment his exercise of such authority is necessary or appropriate to administer the functions vested in him.
