0204-84, Delegation Order No. 0204-84 to the Deputy Secretary of Energy and the Under Secretary of Energy

DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-84 TO THE DEPUTY SECRETARY OF ENERGY AND THE UNDER SECRETARY OF ENERGY Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) by the Regulatory Flexibility Act, Pub. L. No. 96-354, and Sections 501 and 642 of the Department of Energy Organization Act (Pub. L. 95-91), there is hereby delegated to the Deputy Secretary and the Under Secretary the authority: (l) to determine that strict compliance with subsections (b), (c), and (d) of section 501 of the Department of Energy Organization Act would be likely to cause serious harm or injury to the public health, safety, or welfare; (2) to waive the requirements of subsections (b), (c), and (d) of section 501 of the Department of Energy Organization Act after making the determination in paragraph 1 of this Order; (3) to determine that an emergency exists that necessitates waiving or delaying some or all of the requirements of section 603 of the Regulatory Flexibility Act; (4) to determine that an emergency exists that necessitates delaying the completion of the requirements of section 604 of the Regulatory Flexibility Act; (5) to waive or delay the completion of some of all of the requirements of section 603 of the Regulatory Flexibility Act after making the determination in paragraph 3 of this Order; (6) to delay the completion of the requirements of section 604 of the Regulatory Flexibility Act, after making the determination in paragraph 4 of this Order, for a period of not more than 180 days after the date of publication of a final rule in the Federal Register. The authority delegated by this Order shall not be redelegated. In exercising the authority delegated by this Order, the delegates shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary or his designees. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded. 2 Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever, in his judgment, his exercise of such authority is necessary or appropriate to administer the functions vested in him.
