DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-82 TO THE ADMINISTRATORS OF THE BONNEVILLE, WESTERN AREA, AND SOUTHWESTERN POWER ADMINISTRATIONS Pursuant to the authority delegated to me as the Secretary of Energy (Secretary) by the Assistant Attorney General, Land and Natural Resources Division on December 1, 1980 and Section 642 of the Department of Energy Organization Act, Public Law 95-91, there is hereby delegated to the Administrators of the Bonneville, Western Area, and Southwestern Power Administrations the authority and responsibility to approve the sufficiency of the title to land being acquired by purchase or condemnation by the United States for the use of the Department of Energy in connection with acquisition of lands by the Bonneville, Western Area, and Southwestern Power Administrations. This delegation of authority is limited to: (a) the acquisition of land for which the title evidence consists of a certificate of title, title insurance policy, or an owner's duplicate Torrens certificate of title; and (b) the acquisition of lands valued at $100,000 or less, for which the title evidence consists of abstracts of title or other types of title evidence prepared in compliance with the Assistant Attorney General's October 2, 1970 regulations. The authority delegated to the Administrators shall be redelegated, as may be appropriate, but only to attorneys who have at least five years experience in the review of titles to land. In exercising the authority delegated by this Order, or as redelegated pursuant thereto, the delegate shall be governed by the rules and regulations of the Department of Energy as well as the applicable regulations and requirements of the Department of Justice. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded. Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his or her judgment the exercise of such authority is necessary or appropriate to administer the functions vested.
