DEPARTMENT OF ENERGY
DELEGATION ORDER NO. 0204-31
TO THE ASSISTANT SECRETARY FOR DEFENSE PROGRAMS
Pursuant to the authority vested in me as Secretary of Energy and by Executive Order 12065
“National Security Information”, there is hereby delegated to the Assistant Secretary for Defense
Programs the authority to:
1. Administer the DOE implementation of E.O. 12065 and such implementing directives as
are issued.
2. Take the following actions under the referenced sections of E.O. 12065:
A. Designate Secret and Confidential Authorized Original Classifiers in organizations
which do not have a Top Secret Authorized Original Classifier and which are not
under the immediate jurisdiction of another Top Secret Authorized Original
Classifier. (E.O. Section 1-204)
B. Designate officials at the lowest practicable echelons to exercise declassification
and downgrading authority. (E.O. Section 3-103)
C. Issue guidelines for the systematic review of twenty-year old U.S. originated
classified National Security Information and thirty-year old classified foreign
government information under the purview of the DOE. (E.O. Sections 3-402 and
3-404).
D. Review all existing special access programs under the jurisdiction of the DOE and
establish and maintain a system of accounting for any special access programs.

E. Represent the DOE on the Interagency Information Security Committee. (E.O.
Section 5-301)
F. Conduct an active oversight program to ensure effective implementation of E.O.
12065 within the DOE. (E.O. Section 5-404(a))
G. Chair the DOE Classification Review Committee which has authority to act on all
suggestions and complaints with respect to the agency’s administration of the
information security program. (E.O. Section 5-404(b))
H. Ensure that appropriate and prompt corrective action is taken whenever a violation
under Section 5-502 of E.O. 12065 occurs (concerning violation of provisions of
the Executive Order or its implementing directives). (E.O. Section 5-504)

The authority delegated herein to the Assistant Secretary for Defense Programs may be further
delegated, in whole or in part, as may be appropriate.
In exercising the authority delegated by this Order, the delegates shall be governed by the rules and
regulations of the DOE and the policies and procedures prescribed by the Secretary or his
delegate(s).
All actions pursuant to any authority delegated prior to this Order or pursuant to any authority
delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed
and ratified and shall remain in full force and effect as if taken under this Order unless or until
rescinded, amended or superseded.
Nothing in this delegation by the Secretary shall preclude the Secretary from exercising any
authority so delegated whenever in his judgment his exercise of such authority is necessary or
appropriate to administer the functions vested in him.
This Order is effective December 1, 1978.
