DELEGATION ORDER NO. 0204-173
TO THE DEPUTY SECRETARY
1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy and by
sections 202 and 642 of the Department of Energy Organization Act, as amended (Pub. L.
No. 95-91), there is hereby delegated to the Deputy Secretary the authority to take the
following actions:
a. Exercise authority, direction, and control over the Administrator for Nuclear
Security, and the National Nuclear Security Administration (NNSA), including, but
not limited to, the issuance of regulations, directives, and policy that apply to the
NNSA, and the authorities of the Secretary mentioned in sections 3203, 3213,
3242, 3243, and 3292 of the National Nuclear Security Administration Act.
b. As Chief Operating Officer, and as Chair of the Field Management Council, be
responsible for corporate program integration, the integration of support activities
with line programs, and review of all staff and support office policy and guidance
that impact the field.
c. Serve as Chair of the Energy Systems Acquisition Advisory Board.
2. LIMITATION.
a. In exercising the authority delegated by this Order, the delegate shall be governed
by the regulations and rules of DOE and NNSA, as appropriate, and the policies
and procedures prescribed by the Secretary or his delegate.
b. Nothing in this delegation shall preclude the Secretary from exercising any of the
authority so delegated whenever, in his judgment, the exercise of such authority is
necessary or appropriate to administer the functions vested in him.
3. AUTHORITY TO REDELEGATE. The authority delegated to the Deputy Secretary by this
Order may not be further delegated.
4. DURATION AND EFFECTIVE DATE
a. All actions pursuant to any authority delegated prior to this Order or pursuant to any
authority delegated by this Order taken prior to and in effect on the date of this
Order are hereby confirmed and ratified, and shall remain in full force and effect as
if taken under this Order, unless or until rescinded, amended, or superseded.

b. This Order is effective on February 29, 2000.
