DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-161 AMENDMENT NUMBER 1 TO THE ADMINISTRATOR AND CHIEF EXECUTIVE OFFICER OF BONNEVILLE POWER ADMINISTRATION 1. DELEGATION. Under the authority vested in me as Secretary of Energy and pursuant to section 642 of the Department of Energy Organization Act (Public Law 95-91, 42 U.S.C. 7252), Delegation Order Number 0204-161 is hereby amended to read as follows: 1.1 The paragraph numbered 2.b. is rescinded. 1.2 The following paragraph replaces 2.b.: 2.b. Any future Department of Energy directive shall apply to the Bonneville Power Administration unless the directive specifically excludes Bonneville Power Administration. 1.3 The following paragraphs are added after paragraph 2.c.: d. In exercising the authority delegated in this Order, a delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary or delegates(s). e. Any amendments to this Order shall be in consultation with the Department of Energy General Counsel. 2. EFFECTIVE DATE. This Order is effective December 6, 2001. . DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-161 TO THE ADMINISTRATOR AND CHIEF EXECUTIVE OFFICER BONNEVILLE POWER ADMINISTRATION 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy and by section 642 of the Department of Energy Organization Act (Public Law 95-91), there is hereby delegated to the Administrator and Chief Executive Officer of the Bonneville Power Administration (BPA): a. The authority to implement, oversee and enforce the Department of Energy directives specified in the list in Appendix A of items “Delegated to BPA” insofar as such directives or elements thereof apply to BPA. b. Authority under paragraph a. includes the authority to determine which of the delegated Department of Energy directives, or elements thereof, are applicable to BPA and to exempt BPA from such directives or elements thereof. BPA shall have authority to require that officers and employees of BPA, and contractors and subcontractors of BPA, comply with BPA directives in lieu of otherwise applicable DOE directives. 2. LIMITATION. a. Nothing in this delegation is intended to change the Secretary or Deputy Secretary's oversight and supervision of the Administrator. The Secretary or Deputy Secretary may direct the Administrator to take specific actions to comply with delegated Department of Energy directives, or may withdraw a delegation or exemption at any time. b. Any future Department of Energy directives shall not apply to BPA, unless the directive by its terms specifically so provides. c. The directives specified in the list in Appendix A titled “Items Withheld from Delegation” are expressly not included in this delegation of authority, and the directives specified as “Not Applicable to Bonneville” are not affected by this delegation because they do not by their terms or subject matter apply to the Bonneville Power Administration. 3. AUTHORITY TO REDELEGATE. The authority hereby delegated (other than under section 1.b.) may be delegated further, in whole or in part, as the Administrator and Chief Executive Officer determines. 2 4. EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order.

The “precursor” directives will be in effect until the new directive are issued. EXCEPTIONS AND CONDITIONS ON DELEGATED AND EXEMPTION ITEMS A. Equal employment opportunity program authority under O 311.1 is delegated to the Administrator, except for authority to: 1. Issue final agency decision on complaints of discrimination, including complaints dismissed for procedural reason; 2. Process complaints of discrimination that pose a conflict of interest for Bonneville officials; 3. Audit Bonneville’s equal employment opportunity program; and 4. Submit annual reports as required by applicable statues and regulations. B. Training, O 360.1–BPA is exempted from this Order. However, the Department will continue to provide liaison services to BPA to support their training development and training program as requested. The Department will retain statutory responsibilities, as required, in such training areas as needs assessment and planning. C. BPA is granted exemption or delegation for those personnel directives listed below. However, as agreed upon by both Headquarters and BPA personnel staffs, the personnel reports currently required in the Orders will continue to be submitted to Headquarters. D. BPA will comply with the Federal Occupational Safety and Health Administration (OSHA) regulation, 29 CFR Part 1960, in lieu of worker protection provided by Department of Energy Order 440.1.
