DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-157 TO THE ASSISTANT SECRETARY FOR DEFENSE PROGRAMS 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy (“Secretary”), by the Atomic Energy Act of 1954, as amended (42 U.S.C. section 2011, et seq.), and section 642 of the Department of Energy Organization Act (P. L. No. 95-91) there is hereby delegated to the Assistant Secretary for Defense Programs the authority to: a. Issue subpoenas, in accordance with the provisions of section 161c of the Atomic Energy Act, in order to administer the Defense Programs Personnel Assurance Program in accordance with DOE Order 5610.11, “Nuclear Explosive Safety.” 2. LIMITATION. a. In exercising the authorities delegated by this Order or as redelegated pursuant thereto, the delegate(s) shall be governed by the rules and regulations of the DOE and the policies and procedures prescribed by the Secretary and his or her delegates. b. Nothing in this Order shall preclude the Secretary from exercising or further delegating any of the authorities hereby delegated. 3. AUTHORITY TO REDELEGATE. The authority delegated to the Assistant Secretary for Defense Programs may be further delegated, consistent with the terms of the Department of Energy Organization Act, in whole or in part, to any other official in the Department. 4. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified and shall remain in full force and effect as if taken under this Order, unless rescinded, amended, or superseded. b.
