DEPARTMENT OF ENERGY DELEGATION ORDER No. 0204-155 TO THE ASSISTANT SECRETARY FOR DEFENSE PROGRAMS 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) by the President in Executive Order 12958, entitled “Classified National Security Information,” (“Executive Order”), sections 301 and 642 of the Department of Energy Organization Act (Public Law Number 95-91), and sections 141 through 148 of the Atomic Energy Act of 1954, as amended, there is hereby delegated to the Assistant Secretary for Defense Programs the authority to: a. Approve access to classified weapons information. [Atomic Energy Act of 1954, as amended, chapter 12 (42 U. S.C., section 2161-2169)]. b. Provide oversight for Defense Programs' special access programs authorized and created under the Executive Order [Executive Order 12958, section 5.6(c)]. 2. LIMITATION. a. In exercising the authorities delegated by this Order or as re-delegated pursuant thereto, the delegate(s) shall be governed by the rules and regulations of the DOE and the policies and procedures prescribed by the Secretary and his or her delegates. b. Nothing in this Order shall preclude the Secretary from exercising any of the authorities so delegated whenever in his or her judgment exercise of such authority is necessary or appropriate. 3. AUTHORITY TO REDELEGATE. The authority delegated to the Assistant Secretary for Defense Programs may be further delegated, with the exception of 1.b. above, consistent with the terms of the Department of Energy Organization Act, in whole or in part, to any other official of the Department. 4. RESCISSION. This Order rescinds Delegation Order Number 0204-140. 5. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended, or superseded. b.
