DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-152 TO THE DIRECTOR OF THE OFFICE OF CIVILIAN RADIOACTIVE WASTE MANAGEMENT 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy and by the requirements of Section 113(b)(3) of the Nuclear Waste Policy Act, I hereby delegate to the Director of the Office of Civilian Radioactive Waste Management the authority to report not less than once every six months to the Nuclear Regulatory Commission and to the Governor and legislature of the State of Nevada, on the nature and extent of site characterization activities at the Yucca Mountain site and the information developed from such activities. 2. RESCISSION. No previous delegations of authority are rescinded by this delegation order. 3. LIMITATION. a. Each such report will be submitted to the Office of the Secretary at least one week prior to transmittal to the Nuclear Regulatory Commission and to the Governor and legislature of the State of Nevada. b. In exercising the authority delegated by this order, the delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary and the Secretary's delegates. c. Nothing in this order shall preclude the Secretary from exercising any of the authority so delegated whenever in the Secretary's judgment exercise of such authority is necessary and appropriate to administer the functions vested in the Secretary. 4. AUTHORITY TO REDELEGATE. The authority hereby delegated to the Director of the Office of Civilian Radioactive Waste Management may be delegated to the Project Manager of the Yucca Mountain Site Characterization Office, in whole or in part, as the Director of the Office of Civilian Radioactive Waste Management may determine to be appropriate. 5. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to his order or pursuant to any authority delegated by this order taken prior to and in effect on the date of this order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this order, unless or until rescinded, amended, or superseded. 2 b.
