DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-149 TO THE DEPUTY SECRETARY 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) and by section 642 of the Department of Energy Organization Act (Pub. L. No. 95-91), there is hereby delegated on a non-exclusive basis to the Deputy Secretary the authority to take the following actions, as provided in Part 708, title 10, Code of Federal Regulations (hereinafter Part 708): a. Upon the request of a party to a Part 708 proceeding, review the initial agency decision issued by the Director, OCEP, or the Hearing Officer, Office of Hearings and Appeals, as provided in section 708.10; issue the final agency decision; and take appropriate action, as provided in section 708.11; b. Perform such other functions and take such other action provided in Part 708 to be performed or taken by the Secretary or designee, unless expressly delegated otherwise. 2. LIMITATION. a. In exercising the authority delegated by this Order, the delegate shall be governed by the rules and regulations of DOE and the policies and procedures prescribed by the Secretary or her delegate. b. Nothing in this delegation shall preclude the Secretary from exercising any of the authority so delegated whenever, in her judgment, the exercise of such authority is necessary or appropriate to administer the functions vested in her. 3. AUTHORITY TO REDELEGATE. The authority delegated to the Deputy Secretary by paragraph 1.a. of this Order may not be further delegated. The authority delegated to the Deputy Secretary by paragraph 1.b. of this Order may be further delegated at the discretion of the Deputy Secretary. 4. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended, or superseded. b.
