DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-147 TO THE GENERAL COUNSEL 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy and by sections 202(b) and 642 of the Department of Energy Organization Act (Pub. L. No. 95- 91), there is hereby delegated to the General Counsel the authority of the Secretary of Energy under sections 206(b) and 642 of that Act to utilize the Economic Regulatory Administration and the personnel thereof to administer such of the General Counsel's functions as the General Counsel considers necessary or appropriate to carry out the functions of Office of General Counsel. The authority so delegated includes all authority of the Secretary of Energy to provide for continuity in performance of functions of the Economic Regulatory Administration during any period in which there is a vacancy in the Office of Administrator of the Economic Regulatory Administration. 2. LIMITATIONS. a. In exercising the authority delegated by this Order, the delegate shall not transfer from the Economic Regulatory Administration any function vested in it at the time of its consolidation with the Office of General Counsel. b. In exercising the authority delegated by this Order, the delegate shall be governed by the rules and regulations of DOE and the policies and procedures prescribed by the Secretary or her delegates. c. Nothing in this Order shall preclude the Secretary from exercising any of the authorities delegated herein whenever, in her judgment, the exercise of any such authority is necessary or appropriate to administer the functions vested in the Secretary. 3. AUTHORITY TO REDELEGATE. The authority delegated to the General Counsel by this Order may be further delegated, in whole or in part, as the General Counsel may determine to be appropriate. 4. CONTINUITY OF PRIOR DELEGATIONS AND ACTIONS THEREUNDER. a. All prior delegations of authority to the Economic Regulatory Administration or to the Administrator thereof that are in effect on the date of this Order shall remain in full force and effect until revoked, modified, or superseded by the Secretary or by the General Counsel pursuant to the authority delegated by this Order. 2 b. All actions taken pursuant to any authority delegated by this Order prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order unless or until revoked, amended or superseded. 5.
