DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-143 TO THE ASSISTANT SECRETARY FOR DEFENSE PROGRAMS 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy, particularly the authority of section 642 of the Department of Energy Organization Act (Public Law No. 95-91, section 7252, title 42, United States Code), there is hereby delegated to the Assistant Secretary for Defense Programs the authority vested in me under section 3137 of the National Defense Authorization Act For Fiscal Years 1992 and 1993 (Public Law No. 102-190). This delegation includes but is not limited to: a. The authority to operate the National Atomic Museum in such a way as to recruit, train, and accept the services of individuals without compensation (except incidental expenses) as volunteers for the museum. b. To accept and use donations of money or gifts intended for the museum and to make determinations that such gifts are suitable and beneficial for use by the museum. c. To operate a retail outlet on the premises of the museum for the purpose of selling or distributing items of an informative, educational, and tasteful nature relevant to the contents of the museum. d. To exhibit, perform, display, and publish information and materials concerning the holdings of the museum in any media or place at reasonable fees or charges where feasible and appropriate. e. To authorize the use of the net proceeds from these activities for additional activities of the museum. 2. LIMITATION. a. In exercising the authority delegated by this Order, or as redelegated pursuant thereto, the delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary and his or her delegates. b. Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his or her judgment his or her exercise of such authority is necessary or appropriate to administer the functions vested in him or her. 2 3. AUTHORITY TO REDELEGATE. The authority hereby delegated to the Assistant Secretary for Defense Programs may be delegated further, in whole or in part, as the Assistant Secretary for Defense Programs may determine to be appropriate. 4. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this order or pursuant to any authority delegated by this order taken prior to and in effect on the date of this order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this order, unless or until rescinded, amended, or superseded. b.
