DELEGATION ORDER NO. 0204-137
TO THE DIRECTOR OF THE OFFICE OF CIVILIAN RADIOACTIVE
WASTE MANAGEMENT
1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy,
particularly the authority of section 642 of the Department of Energy (DOE) Organization
Act (Pub. L. No. 95-91), section 7252, title 42, United States Code, there is hereby
delegated to the Director, Office of Civilian Radioactive Waste Management of the
Department of Energy the authority to transmit, on a semi-annual basis, site
characterization progress reports for the Yucca Mountain site in the State of Nevada to
the Nuclear Regulatory Commission, the Governor and the legislature of the State of
Nevada, and other interested parties including the United States Congress. The reports
are required under section 113(b)(3) of the Nuclear Waste Policy Act of 1982, as
amended (Pub. L. No. 97-425, as amended by Title V, Subtitle A, of Pub. L. No. 100-
203).
Any such report, which is issued by the Director pursuant to this Order, must be submitted
for concurrence by the General Counsel, the Assistant Secretary for Congressional and
Intergovernmental Affairs, and the Under Secretary of the Department of Energy prior to
its transmittal to the Nuclear Regulatory Commission, the Governor and the legislature of
the State of Nevada, Congress, and other interested parties.
2. REDELEGATION AND LIMITATION. The authority delegated to the Director by this
Order may be further delegated, in whole or in part, to officials within the Office of
Civilian Radioactive Waste Management.
3. RETENTION OF AUTHORITY. Nothing in this Order shall preclude the Secretary from
exercising or further delegating any of the authorities hereby delegated, whenever, in his
judgment, the exercise of such authority is necessary or appropriate to administer the
functions vested in him.
4. DURATION AND EFFECTIVE DATE.
a. All actions pursuant to any authority delegated prior to this Order, or pursuant to
any authority delegated by this Order taken prior to and in effect on the date of this
Order hereby are confirmed and ratified. Such actions shall remain in full force
and effect as if taken under this Order, unless or until rescinded, amended, or
superseded.
b. This Order is effective March 21, 1991.
