DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-136 THE CHAIRMAN OF THE FEDERAL ENERGY REGULATORY COMMISSION 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy, particularly the authority of section 642 of the Department of Energy (DOE) Organization Act (Pub. L. 95-91), section 7252, title 42, United States Code, there is hereby delegated to the Chairman, Federal Energy Regulatory Commission (the Commission), on a nonexclusive basis, such authority to administer and manage the Commission's personnel (including members of the Senior Executive Service) as is not otherwise granted the Chairman by statute. This authority delegated to the Chairman for administration and management of the Commission's personnel shall include, but not be limited to: (1) selection and appointment of personnel; (2) performance appraisals and performance appraisal systems; (3) compensation, promotions, awards, and bonuses; (4) reorganizations, transfers of functions, reductions in force, and the standards governing such reductions; (5) removals and disciplinary actions; and (6) training, travel, and transportation. 2. REDELEGATION. The authority delegated to the Chairman by this Order may be further delegated in whole or in part, within the Commission. 3. DURATION AND EFFECTIVE DATE. It is the position of the Department and of the Commission that the Commission has statutory authority to administer and manage its own personnel. This delegation is intended to remove any doubts about this authority. a. All actions pursuant to any authority delegated to the Chairman or lawfully exercised by the Chairman prior to this Order, or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order, are hereby confirmed and ratified. Such actions shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended, or superseded. b. Order is effective October 3, 1990. /s/ James D.
