DEPARTMENT OF ENERGY
DELEGATION ORDER NO. 0204-134
TO THE ASSISTANT SECRETARY FOR CONSERVATION
AND RENEWABLE ENERGY
1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy
(“Secretary”) and by section 642 of the Department of Energy Organization Act (DOE
Act) (Pub. L. No. 95-91), there is hereby delegated on a non-exclusive basis to the
Assistant Secretary for Conservation and Renewable Energy:
a. all the authority vested in me pursuant to Title V, Part 3 of the National Energy
Conservation Policy Act (NECPA), amended by the Federal Energy Management
Improvement Act of 1988 (42 U.S.C. sections 8251-8261), except the authority to
report annually to the Congress required by section 548(b) of NECPA.
b. The authority vested in me pursuant to section 656 of the DOE Act.
2. AUTHORITY TO REDELEGATE.
a. The authority delegated to the Assistant Secretary for Conservation and
Renewable Energy under Title V, Part 3 of NECPA may be further delegated, in
whole or in part, as may be appropriate.
b. The authority delegated under section 656 of the DOE Act may not be further
delegated.
c. In exercising the authority delegated by this Order or as redelegated pursuant
thereto, the delegate(s) shall be governed by the rules or regulations of DOE and
the policies and procedures prescribed by the Secretary or his delegate.
d. Nothing in this delegation shall preclude the Secretary from exercising any of the
authority so delegated whenever, in his judgement, the exercise of such authority is
necessary or appropriate to administer the functions vested in him.
3. DURATION AND EFFECTIVE DATE.
a. All actions pursuant to any authority delegated prior to this Order or pursuant to
any authority delegated by this Order taken prior to and in effect on the date of this
order are hereby confirmed and ratified, and shall remain in full force and effect as
if taken under this Order, unless or until rescinded, amended or superseded.
b. This Order is effective September 29, 1989.
