[RESCINDED][RESCINDED] DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-129 TO THE ASSISTANT SECRETARY FOR FOSSIL ENERGY 1. DELEGATION. Pursuant to the authority vested in me as Secretary of Energy and by Executive Order 12659 of December 15, 1988 and by Section 642 of the Department of Energy Organization Act (Public Law 95-91), there is hereby delegated to the Assistant Secretary for Fossil Energy the authority to: a. Perform the functions specified in sections 7427 and 7428 of title 10, United States Code, and vested in me by the President of the United States in Executive Order 12659, in order to meet the goals and objectives of the Naval Petroleum and Oil Shale Reserves. b. Perform all functions vested in me by law (Title 10, United States Code, Chapter 641) relating to the administration of and jurisdiction over the Naval Petroleum and Oil Shales Reserves, except for condemnation proceedings and execution of procurement and sales contracts with non-Governmental entities affecting such Reserves. c. Perform all duties and responsibilities required by the Unit Plan Contract between the United States and Chevron USA, Inc., numbered NOd-4219, dated June 19, 1944, and the Amendatory and Supplemental Agreement, as amended, between the same parties, numbered NOd-8477, dated December 22, 1948. d. Perform all duties and responsibilities relative to the disposition of the United States share of petroleum produced from the Naval Petroleum Reserves to or for the Department of Defense and the Strategic Petroleum Reserve pursuant to Section 804 of the Energy Security Act of 1980 (10 U.S.C. Section 7430(k) and (1)). 2. RECISSION. This Delegation of Authority rescinds and supersedes Delegation Order No. 0204-87 from the Secretary to the Assistant Secretary for Environmental Protection, Safety, and Emergency Preparedness, and Amendment No. 1, which reassigned the functions to the Assistant Secretary for Fossil Energy. 3. LIMITATION. a. In exercising the authority delegated by this Order, or as redelegated pursuant thereto, the delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary and his or her delegates. -2- b. Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his or her judgment his or her exercise of such authority is necessary or appropriate to administer the functions vested in him or her. 4. AUTHORITY TO REDELEGATE. The authority hereby delegated to the Assistant Secretary for Fossil Energy may be delegated further, in whole or in part, as the Assistant Secretary for Fossil Energy may determine to be appropriate. 5. DURATION AND EFFECTIVE DATE. a. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order unless or until rescinded, amended or superseded. b. The authority delegated to the Assistant Secretary for Fossil Energy by paragraph 1.a. of this Order shall expire after October 1, 1991, pursuant to the terms and restrictions set forth in Executive Order 12659. c.
