[RESCINDED][RESCINDED] DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-118 TO THE GENERAL COUNSEL AND/OR THE DEPUTY GENERAL COUNSEL FOR LITIGATION Pursuant to the authority vested in me as Secretary of Energy (“Secretary) and by section 19(g) of the Federal Nonnuclear Energy Research and Development Act of 1974 (Pub. L. 93-577, as amended by Pub. L. 95-238) and Section 642 of the Department of Energy Organization Act (Pub. L. 95-91), there is hereby delegated to the General Counsel and/or the Deputy General Counsel for Litigation the authority to represent the Department of Energy and to bid, on behalf of the United States and the Substitute Trustee under the Mortgage dated January 15, 1982 with Great Plains Gasification Associates, at the judicial sale of the Great Plains Project to be conducted pursuant to the Order and Decree of Foreclosure and Sale issued April 7, 1986, and the Order Amending Order and Decree of Foreclosure and Sale and the Order and Memorandum both issued May 8, 1986 by the United States District Court for the District of North Dakota. In exercising the authority delegated by this Order the delegate shall be governed by the rules and regulations of DOE and the policies and procedures prescribed by the Secretary or his delegate(s). Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his judgement his exercise of such authority is necessary or appropriate to administer the functions vested in him.
