DELEGATION ORDER NO. 0204-114
TO THE ADMINISTRATOR OF THE
ECONOMIC REGULATORY ADMINISTRATION
Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) and by Section 642 of
the Department of Energy Organization Act (Pub. L. 95-91), nothwithstanding any previous
Delegation Order, with respect to any Entitlements exception order there is hereby delegated to the
Administrator of the Economic Regulatory Administration the authority to prescribe the policies
and procedures which shall govern the issuance, the modification, the rescission, and the
effectuation of any such exception order, including orders issued prior to this Order. An
Entitlements exception order is an exception order which relates to the Entitlements Program, 10
C.F.R. Part 211.
Any policy and procedure established pursuant to the authority delegated to the Administrator by
this Order shall be considered a policy or procedure prescribed by the Secretary or his delegate
for purposes of Delegation Order No. 0204-24, but shall not otherwise impair or supplant the
authority previously delegated to the Director of Hearings and Appeals.
Nothing in this Order shall preclude the Secretary from exercising any of the authorities so
delegated whenever in his judgment his exercise of such authority is necessary or appropriate to
administer the functions vested in him.
This Order is effective December 20, 1984.
