DEPARTMENT OF ENERGY DELEGATION ORDER NO. 0204-103 TO THE ASSISTANT SECRETARY FOR CONSERVATION AND RENEWABLE ENERGY1 Pursuant to the authority vested in me as Secretary of Energy and section 642 of the Department of Energy Organization Act (Pub. L. 95-91), there is hereby delegated, when there is an absence or other vacancy in the office of the Director of the Office of Alcohol Fuels, to the Assistant Secretary for Conservation and Renewable Energy the authority to carry out, on an exclusive basis and as Acting Director of the Office of Alcohol Fuels, the functions vested in the Secretary of Energy by Subtitle A of Title II of the Energy Security Act (ESA) (Pub. L. 96-294) including selecting recipients of financial assistance under sections 212, 214, 215, and 216 of the ESA and making the findings and determinations required by sections 214, 215, 216, and 217. The exercise of the authorities delegated pursuant to this Order are to be carried out through the Office of Alcohol Fuels. In the absence or other vacancy in the office of the Director of the Office of Alcohol Fuels, the authorities delegated to the Assistant Secretary for Conservation and Renewable Energy by this Order may be further delegated, in whole or in part, to the Deputy Director of that Office or an equivalent official within the Office, with the exception of final selection of the recipients of financial assistance and making the required findings and determinations pursuant to sections 212, 214, 215, 216, and 217 of the ESA. In exercising the authority delegated by this Order the delegate shall be governed by the rules and regulations of the Department of Energy and the policies and procedures prescribed by the Secretary or his delegates. All actions pursuant to any authority delegated prior to this Order or pursuant to any authority delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed and ratified, and shall remain in full force and effect as if taken under this Order, unless or until rescinded, amended or superseded. Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated whenever in his judgment his exercise of such authority is necessary or appropriate to administer the functions vested in him.
