DELEGATION ORDER NO. 0204-102
TO THE CHAIRMAN OF THE EXECUTIVE PERSONNEL BOARD
Pursuant to the authority vested in me as Secretary of Energy (“Secretary”) and by Section 642 of
the Department of Energy Organization Act (Pub. L. 95-91), there is hereby delegated to the
Chairman of the Executive Personnel Board, on an exclusive basis, the authority to:
1. Approve Departmental policies and procedures concerning the Senior Executive Service
(SES) and other executive positions (positions classified above the GS-15 level of the
General Schedule and not designated above Level IV of the Executive Schedule, or their
equivalent, except for Presidential appointees and Administrative Law Judges).
2. Approve all actions relating to the establishment, distribution, and termination of SES
positions and other executive positions.
3. Approve all actions relating to the selection, appointment, pay, awards and bonuses,
performance rating, transfer, reassignment, reductions-in-force, furlough, removal, and
discipline of employees in SES and other executive positions.
4. Take such other actions as necessary to carry out the authorities delegated by this Order.
The authorities delegated to the Chairman of the Executive Personnel Board by this Order may be
exercised by the Vice Chairman of the Executive Personnel Board in the absence of the Chairman
or when there is a vacancy in the office of the Chairman. The Vice Chairman may exercise any
authority delegated by this Order when the Chairman cannot otherwise exercise such authority.
The authorities delegated to the Chairman of the Executive Personnel Board by this Order may be
delegated, in whole or part.
In exercising the authority delegated by this Order or as redelegated pursuant thereto, the
delegate(s) shall be governed by the rules and regulations of DOE and the policies and procedures
prescribed by the Secretary or his delegate(s).
All actions pursuant to any authority delegated prior to this Order or pursuant to any authority
delegated by this Order taken prior to and in effect on the date of this Order are hereby confirmed
and ratified, and shall remain in full force and effect as if taken under this Order, unless or until
rescinded, amended or superseded.
Nothing in this Order shall preclude the Secretary from exercising any of the authority so delegated
whenever in his judgment his exercise of such authority is necessary or appropriate to administer
the functions vested in him.
This Order is effective October 22, 1982.
